Seit ihrer Grndung im Jahr 1992 bert die Deutsche Stiftung fr internationale rechtliche Zusammenarbeit e.V. (IRZ) ihre Partnerstaaten im Auftrag des Bundesministeriums bei der Reformierung ihrer Rechtssysteme und der Justizwesen. Rechtsstaatlichkeit und Demokratisierung sind Voraussetzung und Garant, um grundrechtliche Freiheiten zu wahren, stabile staatliche und gesellschaftliche Strukturen zu strken sowie wirtschaftliches Wachstum anzuregen. Diesen Entwicklungsprozess zu untersttzen ist Aufgabe der IRZ, wobei die Bedrfnisse des jeweiligen Partnerstaats immer im Mittelpunkt stehen. Die Zusammenarbeit der IRZ mit Georgien basiert auf einer gemeinsamen Erklrung zwischen dem georgischen Justizministerium und dem Bundesministerium der Justiz von 2005 und wurde im Jahr 2006 aufgenommen. Die Schwerpunkte der Ttigkeit liegen in der Umsetzung internationaler Abkommen in georgisches Recht, in der Beratung im Straf und Strafvollzugsrecht sowie der Aus und Fortbildung von Rechtsanwendern.

Sie halten die georgische Ausgabe des Kropholler in Hnden, eines deutschen Studienkommentars zum deutschen Brgerlichen Gesetzbuch (BGB). Vielleicht fragen Sie sich, warum wir uns zu dieser Publikation entschieden haben. Das georgische Zivilgesetzbuch (ZGB) besitzt als grundlegende Kodifikation privatrechtlicher Verhltnisse fr die Rechtspraxis in Georgien herausragende Bedeutung. ZGB und BGB sind in weiten Teilen miteinander verwandt. Wer mit ZGB oder BGB vertraut ist, findet sich rasch auch in dem jeweils anderen Gesetz zurecht. Mehr noch: Wer das ZGB anwenden mchte, wird in Rechtsprechung und Fachliteratur zum BGB oftmals auf hilfreiche Anregungen stoen. Insbesondere in BGBKommentaren: Denn Richter, Rechtsanwlte, Wissenschaftler, Studierende und andere Anwender des ZGB gehen in der Regel von bestimmten Vorschriften aus, und anders als Lehrbcher und Monographien erschlieen Kommentare den Gesetzesinhalt gerade Vorschrift um Vorschrift. Als Anwender von ZGBVorschriften knnen Sie mit der georgischen Ausgabe des Kropholler also rasch ermitteln, welchen Inhalt die entsprechenden BGBNormen haben, ergnzt um Rechtsprechungspraxis und Stand der wissenschaftlichen Diskussion in Deutschland.

In Georgien befindet sich ein Kommentarwesen erst im Entstehen. Mit der georgischen Ausgabe des Kropholler mchten wir ZGBAnwendern ein ntzliches Hilfsmittel an die Hand geben, gerade auch solange noch kein aktueller Kommentar zum ZGB vorliegt. Auch hoffen wir, dass der Kropholler georgische Juristen von der Ntzlichkeit moderner Kommentare berzeugen und ihnen als Muster dienen kann, selbst Kommentare zum ZGB, aber auch zu anderen Gesetzen in Angriff zu nehmen.

Zur einfacheren Orientierung haben wir dem Kommentar eine Synopse vorangestellt, aus der hervorgeht, welche ZGB welcher BGBVorschrift entspricht. Zu manchen Vorschriften werden Sie ausfhrliche Kommentare finden, zu anderen nur knappe oder auch gar keine. Dies ist dem Charakter des Kropholler als Studienkommentar geschuldet, der sich auf wesentliche Vorschriften konzentriert und Regelungen mit geringerer Praxisrelevanz unkommentiert lsst. Auch haben wir entschieden, die bersetzung auf Allgemeinen Teil, Schuldrecht und Sachenrecht (1.3. Bcher des BGB) zu beschrnken und auf den Kommentar zum

Familien und Erbrecht (4.5. Bcher des BGB) zu verzichten. So konnten wir Zeit und Aufwand fr bersetzung, Redaktion und Produktion in angemessenem Rahmen halten.
