ตามที่พระราชบัญญัติการศึกษาแหงชาติ พ.ศ.2542 และแกไขเพิ่มเติม (ฉบับที่ 2) พ.ศ.2545มาตรา 10 วรรคสี ่ กำหนดใหการจดัการศกึษาสำหรบับคุคลซึง่มคีวามสามารถพเิศษตองจดัดวยรปูแบบที่เหมาะสม โดยคำนงึถงึความสามารถของบคุคลนัน้ และในมาตรา 28 ยงัไดกำหนดใหหลักสตูรการศกึษาสำหรับบุคคลซึ่งมีความสามารถพิเศษตองมีลักษณะหลากหลาย ทั้งนี้ ใหจัดตามความเหมาะสมของแตละระดบั โดยมงุพฒันาคณุภาพชวีติของบคุคลใหเหมาะสมแกวยัและศกัยภาพ
