✧ Chairman’s View ✧Code of EthicsRecently, I was speaking with a fellow ABC member who was talking about how proud he was to be part of ABC Keystone – to be associated with the “cream of the crop” in the industry. I asked him why he thought ABC members were, in fact, the “cream of the crop?” He answered that ABC members are the people in this industry who are genuinely concerned about the industry, and that we work to drive the industry forward for the good of all, in the spirit of free enterprise. I thought that was a fantastic answer.So, I pressed him a little more. I inquired as to what makes the companies and people associated with ABC interested to work for the good of all, rather than only the good of themselves? “Well,” he said, “aren’t you in fact working for the good of your own business if you’re working for the good of the industry as a whole? And aren’t we a lot more effective if we work together than by ourselves?” Of course, that seems obvious to some (probably those of you already reading this), but not everyone shares his simple philosophy. We have to remember to continuously promote the values and philosophies that make ABC great. I thought back to a Code of Ethics task force I participated in with ABC around 2012. The task force was charged with the daunting task of helping to promote fair business practices among ABC members. Let’s face it; a few individuals who sometimes challenge our industry give a bad name to those who work hard to provide good, honest service. The task force realized we could not police ethics in the industry; all we could merely do was promote it. My suspicion is that ABC members are not those who need ethics promoted in their businesses.I compare this notion of being amongst the best in ABC to being in a competitive sports league. When you compete with the best, it also makes you better. I remember as a young boy, I had a basketball coach who would always take the team to scrimmage with inner city schools teams. They played unlike any of the suburban or rural teams in our league. But that was the point. The kids from the inner city teams were twice as fast, much taller, and could shoot better than anyone we came up against in our league. In the end, we trounced the teams in our league. Thanks coach.So, did ABC get to be the cream of the crop because of the members? The answer is sort of an irrelevant chicken and egg question. I know I’m glad to be surrounded by so many good companies and people I’ve grown to call friends that we can call on when we have industry needs. It has made us better; I hope it’s making you better too.

Fewer New Businesses? No Wonder.

In a Wall Street Journal article last week covering the latest U.S. Census Bureau statistics on the growth in the number of new U.S. businesses between 2007 to 2012, it reported the growth rate of the total number of U.S. companies during that time period managed a feeble 2 percent. Worse yet, the number of companies with paid employees actually fell by 5% -- and is presently below 2002 levels.The WSJ article cites some contributing factors as slower population growth, increased business concentration and greater regulation, but the overall tone of the contributors to the article, including economists and think tanks, is one of surprise. After all, while the article didn’t quote any elected officials, I am sure you could just ask all of the politicians who heap on new regulations and taxes -- isn’t running a small business an easy job where the owner just sits back and rakes in profits? Yeah, right. Are these statistics alarming? They should be. Are they surprising? Not hardly. The truth is that these statistics are merely a sad reflection on how terribly difficult and grinding it has become to be a business owner in today’s world.Between government meddling, onerous taxes, plaintiffs’ attorneys, a shrinking pool of quality workers and a myriad of other everyday nightmares, it is no wonder that there are far fewer brave souls these days who are willing to shoulder all the risks associated with starting – and then running -- a business.One thing is for certain – the Census Bureau statistics

should cause alarm bells to be sounding in the halls of Congress and state capitols across the country. Truly, the U.S. economy, and the fate of our workers and their families rests on those bold and fearless souls who lay it all on the line to launch into the scary and vexing world of business ownership, and then each and every day make the sacrifices necessary to succeed. Yes, the alarm bells should be sounding, but the pols and commentators should quit scratching their heads wondering as to the reasons, and instead simply look in the mirror. For without a doubt, to a great degree federal and state politicians, along with their bureaucrats, are the cause of much of the chagrin suffered by small business owners on a daily basis, and are the principle reason the growth in business start ups has faltered.Fewer new businesses? No wonder. Listen up, Washington D.C. Hear the alarms, Harrisburg. You just may be the biggest cause for a looming crisis.

When opponents to industry licensing need a good example of why a new level of government bureaucracy would be detrimental to the trades, they generally need to look no further than the Home Improvement Contractor Protection Act (HICPA). Signed into law in 2008, HICPA implemented a mandatory registration process for home improvement contractors, requiring documentation of essential insurance coverage and contact information with the Pennsylvania Office of the Attorney General and a biennial fee. While the Act has never technically constituted licensing, the disastrous implementation of the law has served as a cautionary tale to pro-licensing proponents ever since.

Rather than achieving its ideal goal of cracking down on unscrupulous home improvement contractors, often affectionately referred to a “trunk slammers,” the law provided little in the way of resources for the OAG to investigate and prosecute fraudulent scofflaws. As a result, many of the mandated portions of HICPA go uninvestigated and frequently, consumer reports of violations go ignored.

So, why even start the debate on licensing?

For starters, Pennsylvania is one of only four states in the nation that maintains no type of trade licensing related to construction. Most states maintain even a basic level of licensing standards, from cost thresholds (any contractor in Arizona performing work valued in excess of $750 must be licensed) to trade-specific licensing (Illinois requires only roofing and plumbing contractors to be licensed). In the northeast, this frequently creates reciprocity issues, when contractors perform work in multiple states. While 20 years of experience as a plumber in Pennsylvania is enough to satisfy many consumers, it’s simply not enough to satisfy the Maryland Board of Plumbing and that can prevent many ABC members from working across state borders.

Doing business in a state without licensing can also present the obvious consumer protection issues since it’s easy to point out that anyone with a work truck, gloves and some basic information can call themselves an electrician. This doesn’t offer any comfort to the homeowner, who has no idea that, as long as the finished product meets the Uniform Construction Code (UCC) standards, the quality of workmanship is anyone’s guess. Even then, most licensing proponents point out that Pennsylvania’s UCC Review & Advisory Council rejected International Code Council (ICC) triennial code updates for the past six years, meaning that the Commonwealth’s construction industry continues to build to

2009 standards, despite sweeping changes in several areas.

The legislature continues to focus on licensing for a variety of trades, but four main areas repeatedly return: plumbing, electrical, elevator installation and inspection, and interior design. During the 2013-2014 legislative sessions, Sen. Ted Erickson (R-Delaware) introduced Senate Bill 441, which provided for the licensing of plumbing professionals. The bill was successfully approved by the Senate in a 47-3 vote, but never received consideration by the House Labor & Industry Committee.

During his tenure, former Governor Tom Corbett pledged not to add the government expenses of new licensing structures, and held the line against licensing of any industry. Because of this public pledge, House members frequently felt that any attempt to offer the Governor a licensing bill would be met with a veto, and as such, no licensure bill left the House of Representatives from 2010 to 2014. However, now with Governor Tom Wolf, licensure is being revisited by proponents in both chambers. As both sides continue to struggle over how licensing will affect the construction industry in Pennsylvania, ABC plays a pivotal role in ensuring a responsible standard of workmanship while balancing the merits of free enterprise. Ultimately, any licensing must benefit the industry over which it watches, and ensure that business is allowed to prosper by providing safe, quality services to consumers.

Why is the Seven-Day Week Important to Wise Financial Investment and Planning?

The book “Know the Time, Change Your World” by Barry Miller answers that question with a study of those seven days.

What inspired you to write about this subject?BM: The stock market crash of October 1987 really scared me because I had just bought a house and a business. I also had family history that my grandfather had lost his farm because of the Great Depression, which started just after the October 1929 stock market crash. Everything

worked out fine for me in the late ‘80s, but in 1991 I realized that Deuteronomy called for a cancelation of debts in the fall every seven years. I began to ask the question: could I connect October 1929 and October 1987 to the instruction from Deuteronomy? This book is the result of my research and real life risk-taking as I attempted to answer this question over the last quarter century.

How can ABC members relate to and apply the seven year and fifty year cycle in the construction industry?BM: Mark Twain reportedly said that “History does not repeat itself, but it does rhyme.” ABC members would do well to learn how to spot the rhymes. Often, the construction industry is too optimistic in the good times and too pessimistic in the lean times. In the book, I go in to a lot of details, which gives the reader information about how to think about specific segments of time and their relationship to each other.

What new opportunities are you looking forward to in 2016?BM: In 2016, I think the opportunity will be great, but there will still be a lot of chaos in the marketplace and one will need to look carefully for good opportunities; however, I expect aggressive choices in 2016 and 2017 will be rewarded handsomely.

What points do you most hope readers take away after reading your book?BM: I hope my readers gain an understanding of how the element of time affects our lives. Time is not simply a straight line in which we simply count up, it is also a circle which repeats itself in what I like to call 7 and 50 year rhymes. I hope my readers work hard, take risks and do all they can to be de-levered at the critical moments.

Any plans to write another book? BM: I have a lot of work in front of me to get this message out before I take on another book. For the time being, I hope to do workshops and other presentations, which will open this understanding to a wider audience. So, will I write another book? Maybe, but I expect that’s a few years out.

In the mid 1980’s, he had a significant role in starting ESCO Security and became a partner in the organiza-tion. Barry spent numerous years supporting customers, managing projects and developing installation crews. He now enjoys using his years of experience in the electrical industry to find innovative solutions which make energy and financial sense for MVE Group customers. He also served as the 2013 ABC Keystone Chairman of the Board.

Is your performance similar to your competi-tors? Do you know how third parties analyze your com-pany? If you answered ‘No’ to any of these questions, it’s time to conduct a benchmarking analysis. Benchmarking is the comparison of your company to similar businesses as well as a comparison to your historical self. This process can help you see how your company compares to your contractor peers. In addi-tion, a multi-year trend analysis of your own financial statements can help you identify positive and negative trends. Finally, knowing what your third-parties are look-ing at and how they analyze this information will help you run your business accordingly. A complete benchmarking analysis should include a fi-nancial statement ratio and contract profit analysis. The ratios are in each of the following four categories. These categories are 1) liquidity ratios, 2) profitability ratios, 3) leverage ratios, and 4) efficiency ratios. In addition, it is important to focus on your individual contracts’ profit-ability. You should know where you make money and where you don’t. Only then can you capitalize on your strengths and eliminate your weaknesses. Liquidity is the measure of how you are able to pay your bills. These ratios will tell you if your receivables are

enough to cover your payables and whether you have adequate amounts of cash on hand. Profitability mea-sures your return on the investment in the company. Leverage assesses your debt load and ability to pay it back. Finally, efficiency measures the company’s ability to operate. Efficiency ratios include the amount of back-log on hand and analysis of how long it takes a company to turn a dollar of cost into collected revenues. In addition to these ratios, benchmarking should include a review of your profitability and estimating ability on jobs. In doing so, you will know if your estimators are hitting the mark when bidding jobs. You will see which project managers maintain the profit versus those who don’t. You will see what kind of projects you are good at versus those which should not be pursued further. Benchmarking on your contracts should include com-parison of such items as profit by project manager, origi-nal estimated profit to final profit by estimator, profit by type of work, profit by size of work, etc. Knowing these specifics of your business will give you a better idea how to manage going forward. If you are not benchmarking your company right now, don’t wait! The process may be eye opening. Talk to your CPA about benchmarking. Any reputable construction CPA will be able to help you develop a proper bench-marking process for your company. So, get at it and benchmark today!

Most of us (thankfully) won’t have to solve for ‘x’ again in our natural lives, but there’s a part of that algebraic experience we use every day: problem-solving. Knowing a Pythagorean Theorem may not be considered a necessary skill, but the ability to provide solutions – now, that is essential.

We solve problems so frequently, we usually don’t realize we’re doing it. As natural as it can be, problem-solving is also a skill that can be refined and improved upon. Below are some steps to effectively providing solutions:

Determine the end resultState the desired outcome as simply as possible. For example: “we need to install a new roofing system” or “we need to keep costs in line with this new build.” Stating the problem outright sets a clear goal to help achieve the desired outcome.

Identify the problem(s)Begin with what you know. Start with “the constants” in the equation.

List the constants you know may be problematic. For example:

• Zoning restrictions• Equipment and materials challenges• Construction or repair to facilities in full operation

Do the researchResearch various processes, case studies, testimonials – whatever you can get your hands on that provides relevant information for your scenario. Brainstorm with others whose experience and knowledge you respect. Specifically,

Solve for x.

if you’re a young professional, take advantage of the wealth of wisdom surrounding us.

Factor in variablesAlong with the more obvious problems, you also need to determine the variables. Solve for ‘x.’

Possible variables include:

Testing the Limits of Insurance Coverage

Generally, insurance policies cover “occurrences” or “accidents” that cause bodily injury or property damage. When an accident occurs, the resultant damages can take various forms. There will always be a direct injury. For example, when an insured’s actions cause a person to be injured, a direct damage would be the actual bodily injury suffered by the harmed individual.But what about other, indirect damages caused by an accident? What if the accident delays work for a few weeks—either due to clean-up, safety, or other reasons? And what if the delay causes the project to miss final completion deadlines, thus resulting in liquidated damages being assessed? Depending on the circumstances, the insurer might cover those indirect damages, too. In Mattiola Construction Corporation v. Commercial Union Insurance Company, the Philadelphia County Court of Common Pleas held that the insurer was required to cover liquidated damages assessed by the owner on a project [60 Pa. D.&C.4th 412 (C.P. 2002)]. In Mattiola, a subcontractor accidentally cut structural steel members on a bridge, which resulted in the stoppage of all work on the project. Due to the stoppage of work, the project missed its final deadline, and the owner assessed $75,900.00 in liquidated damages to the general contractor. In turn, the general contractor withheld that amount from the subcontractor.The court held that the subcontractor’s insurer was obligated to pay the liquidated damages, because the stoppage of work and corresponding liquidated damages arose from the property damage. Likewise, in Cincinnati Ins. Co. v. Fab Tech, Inc., the United States District Court for the District of New Hampshire followed this same reasoning [2005 WL 1492377 (2005) (not reported)]. In the Fab Tech case, a tenant was using a building for document storage. The building collapsed, and the tenant incurred expenses to relocate and protect the documents. The court held that the costs of relocation were covered by the negligent party’s insurer, because these costs arose from the “loss of use” of the building.Not all cases will result in coverage being afforded. But, when presented with losses from an accident, it is wise to consult your insurer and an attorney to determine whether indirect damages will be covered. Bright Lights, Big Savings

Have you noticed how many of your competitors have switched to LED lights? Increasingly, companies are choosing to upgrade to LED because of the high cost of energy and maintenance required by their old fixtures. Today’s retrofit projects are regularly seeing annual returns on investment (ROI) of 20-70%. The best returns are typically on outdoor lighting that burns all night, any indoor space where lights are on for more than one work shift, or any area that the existing fixtures are starting to need maintenance such as replacement of lamps or ballasts.

Why LED?Environmentally-friendly LEDs (or Light Emitting Diodes) use semiconductors to transform electricity into light. Recently, substantial technology breakthroughs and cost reductions have made LED lighting an extremely attractive replacement for traditional lighting:

Falls are the leading cause of worker deaths in construc-tion, and have been for many years.As per OSHA requirements - all employees exposed to fall hazards must receive training. OSHA recognizes that accidents involving falls are generally complex events frequently involving a variety of factors. Consequently, the standard for fall protection deals with both the hu-man and equipment-related issues in protecting workers from fall hazards. For example, employers and employ-ees need to do the following:

• Where protection is required, select fall protec-tion systems appropriate for given situations.

• Use proper construction and installation of safe-ty systems.

• Supervise employees properly.• Use safe work procedures.• Train workers in the proper selection, use, and

maintenance of all protection systems.ABC Keystone will offer “Competent Person for Fall Protection” training on Thursday, November 5, 2015, from 12:30 pm – 5:30 pm. This training provides

the competent person with the safety knowledge needed to confidently identify, plan and manage effective fall prevention and protection strate-gies on the jobsite. OSHA regulations and relevant OSHA interpretations are

Time Management: Making Every Moment Count!

In today’s business world we all have multiple responsibilities, but we only have 24 hours in the day. You have to ask yourself, what are you doing with your time and are you being efficient and productive. Here are some thoughts for you to consider:

• How do you spend your time? All of us has a limited number of hours that we work and you must first determine how you currently spend your time. Are you working on priorities? Are you doing tasks you should not be doing? Evaluate how you spend your time and what is taking your time.

• Look for time wasters! Each of us should evaluate the tasks we are doing and find out what is not productive and efficient. Then take steps to rid yourselves of these tasks or responsibilities.

• Establish a goal! Determine what you want to achieve and how much time it will take. Once you make that decision then manage yourself to get the time necessary to achieve your goal.

• Use time management tools - As a business person you have technology tools that can help you save time and then focus on your priorities. Make sure you know how to use your smart phones, computers and software systems to help you use time more efficiently and productively.

• Delegate, Delegate, Delegate! If you are performing tasks that aren’t your responsibility then delegate them to other associates. Build your team by giving others some of the tasks that you are keeping because you like to do them.

• Establish time limits - When you manage your time you are going to estimate how long it should take to perform a task or responsibility. Adhere to your time limits.

• Do not wait - If you wait for meetings to start or wait for someone to start a meeting do not waste that time. Bring something with you to work on so that you are being productive.

Businesses today know that quality customer service is important, but businesses do not usually pay attention to it. They think people will buy their goods and services even though your employees may not have handled the customer in a pro-fessional manner. Each person in your organization should focus on quality customer service. It is easier to retain a customer than it is to secure new customers.

Consider some of the following to evaluate your quality customer service:

• Evaluate Your Leadership - Do you model good customer service or do you think the customer is always wrong? Your associates will look to you as that role model.

• Establish Expectations - Do you have a list of customer service expectations? You should train your associates on how you want them to treat customers.

• Do You Have Committed Employees? Happy employees will treat customers with respect and they can address customer issues. The question is - do you take care of your employees? If you have unhappy employees, then you are going to have unhappy customers.

• Build Trust - Do your customers know that you will stand by your products and services? Ask your customers how you are doing and are they pleased with the goods and services provided by your organization. Make sure you know that the customers trust your organization and its employees.

• Resolve Customer Issues - Each of us should be willing to address a customer’s concern or issue. They come to us with problems, and we must be willing to listen and make every attempt to satisfy our customers.

• Hire for Customer Service - Your hiring process should include questions that make you feel confident that the person will handle customers professionally. Make sure you are evaluating that new employee in terms of how they will treat your customers.

Do you perform renovation, repair, and painting (RRP) projects that could disturb lead-based paint in homes, child care facilities and pre-schools built before 1978? If you answered “yes,” Federal law requires that any contractor performing reno-vation, repair and painting (RRP) projects that disturb more than six square-feet of interior paint or twenty square-feet of exterior paint OR replacement windows regardless of size and number - in homes, child care facilities and schools built be-fore 1978 MUST be certified and trained to follow specific work practices to prevent lead contamination.
