KPM-Leuchten wurde 1979 gegründet und wird jetzt in der zweiten Generation weitergeführt.

In den über 30 Jahren war es immer unser Bestreben, Leuchten mit klaren Formen und zeitlosem Design zu produzieren, unter Verwendung edler Materialien wie Messing und mundgeblasenen Gläsern.

KPM-Leuchten ist seit vielen Jahren ein verlässlicher Partner für den Fachhandel, der sich auf Qualität und ein ausgewogenes Preis-Leistungsverhältnis unserer Produkte verlassen kann. Der Standort Deutschland und das Markenzeichen „Made in Germany“ zeichnen unsere Leuchten aus.

Mit diesem Katalog stellen wir eine Produktpalette vor, bei der wir schwerpunktmäßig das Thema „Energiesparmaßnahmen“ berück-sichtigt haben. Durch den Einsatz von Energiespar-Leuchtmitteln kann der Verbraucher seine Energiekosten merklich senken.

KPM-Leuchten was founded in 1979 and is now a family-run busi-ness in its second generation of ownership.

For over 30 years we have endeavoured to produce lighting with clear shape and timeless design using quality materials such as brass and hand-blown glass.

KPM-Leuchten has been a reliable partner for many years in the specialized lighting market where our quality and well-balanced price-performance ratio are known for their reliability. Germany as location for our business and the trademark ‘Made in Germany’ are special characteristics of our lighting.

This catalogue presents a range of products with special emphasis on the theme ‘reduction of energy consumption’. By using energy-effi cient lamps it is possible for the consumer to considerably reduce energy costs.

Unser CANTA-Schienensystem made by KPM bietet unzählige

Möglichkeiten der individuellen Lichtgestaltung im ganzen Haus.

Je nach Bedarf kann das System linear, über Eck oder in Kurven

dort hin geführt werden, wo es wirklich benötigt wird. Lang-

gestreckte Räumlichkeiten können durch eine quer geführte

Installation optisch verkürzt werden, und hohe Decken wirken

niedriger, wenn das Schienensystem entsprechend tief von der

Decke abgehängt wird. Durch die Vielzahl der Anordnungsmög-

lichkeiten empfehlen wir die Planung mit Ihrem Leuchtenfach-

geschäft, einem Elektroinstallateur oder mit einem Lichtplaner

vorzunehmen. So ist sichergestellt, dass die Anzahl der Leuchten

auf die Leistung der Transformatoren abgestimmt und das erfor-

derliche Zubehör für den Aufbau des Systems passend ausge-

wählt ist. Die Installation sollte zur Sicherheit immer über den

Fachmann erfolgen.

The new generation of energy-saving low-voltage halogen

lamps is extremely effi cient. A long life of up to approx. 4000

hours, excellent light effi ciency of 20-28 lumens per watt and

a colour rendering index of Ra 100 make this lamp appear

particularly suitable for home use or other areas where a sen-

se of �well-being’ is important.

Our CANTA rail system, made by KPM-Leuchten, provides nu-

merous possibilities for individual lighting design throughout

the home. As required the system can be directed straight,

cross-corner or curved to wherever it is really needed. Espe-

cially long rooms can be optically shortened by an installation

mounted across the room and high ceilings appear lower if

the rail system is hung at a greater distance from the ceiling.

As the possibilities for arrangement are so varied, we recom-

mend that planning is carried out by a specialised dealer, an

electrician or a lighting designer. In this way it is possible to

ensure that the number of lamps matches transformer per-

formance and that necessary accessories are selected for as-

sembly of the system. For safety reasons installation should

always be carried out by an expert.

Das CANTA-Schienensystem made by KPM ermöglicht dem

Anwender aus einer Vielzahl von Strahlern und Pendelleuch-

ten die geeigneten Modelle in drei verschiedenen Ober-

fl ächen auszuwählen. Egal ob in der Küche, im Flur, im Ar-

beitszimmer oder immer dann, wenn eine Beleuchtung dort

gewünscht wird, wo es keine geeignete Stromzufuhr gibt,

zeigt das variable CANTA-Schienensystem seine Stärken.

Wie bieten Ihnen eine Vielzahl geeigneter Transformatoren,

die an die vorhandene Stromzufuhr angeschlossen werden

können. Von dort kann das Schienensystem weitergeführt

werden. Mit Strahlern können Bilder akzentuiert angestrahlt

werden und über Tischen lassen sich Einzelpendel anbringen,

die bei Bedarf jederzeit in ihrer Position veränderbar sind.

Nahezu alle Strahler werden in drei verschiedenen Längen

geliefert, damit bei jeder möglichen Deckenhöhe die geeig-

neten Lichtpositionen zur Verfügung stehen.

The CANTA rail system, made by KPM-Leuchten, provides the consumer with the opportunity to select

suitable models from a wide range of spots and pendant lights in three different fi nishes. Whether

in the kitchen, in corridors, in the home offi ce or anywhere lighting is required but no appropriate

current supply is available, the variable CANTA rail system proves its strong points.

We offer a variety of suitable transformers that can be connected to the available current supply.

The rail system can be continued from there. Spots can be used to direct accent light to pictures and

individual pendants can be mounted above tables and their position changed at any time, as required.

Almost all spots are supplied in three different lengths, making available the optimum lighting posi-

tions for every possible ceiling height.

Mit unserem Niedervolt 2-Stangen Schienensystem und den vielen Zu-behörteilen lassen sich nahezu alle Beleuchtungsprobleme lösen. Achten Sie bitte darauf, daß pro Stromkreis nur eine maximale Schienenlänge von 8 Metern erlaubt ist. Danach muß er-neut eingespeist werden. Um eine ge-eignete Stabilität des Schienensystems zu gewährleisten, wird empfohlen, etwa alle 80 cm eine Decken- oder Wandbefestigung (KPM 516) zu set-zen. Durch das höhere Gewicht grö-ßerer Pendel wie z.B. KPM 5000 oder KPM 5005, sollten Sie jeweils links und rechts eine zusätzliche Deckenbefes-tigung (KPM 516) einplanen. Ferner weisen wir ausdrücklich darauf hin, daß bei ungedimmten, besonders aber bei gedimmten Ringkern-Transfor-matoren Brummgeräusche nicht aus-geschlossen werden können! Es muß unbedingt darauf geachtet werden, daß zum Dimmen von Ringkern- und konventionellen Transformatoren nur Phasenanschnitt-Dimmer eingesetzt werden, wogegen elektronische Trans-formatoren nur mit Phasenabschnitt-Dimmer gedimmt werden dürfen.

With our low-voltage CANTA rail sys-tem and its many accessories a solution can be found for almost every lighting problem. Please note that a maximum rail length of 8 metres is permitted per circuit. After that a new feed is necessary. To guarantee the stabili-ty of the rail system we recommend installing a ceiling or wall mounting device (KPM 516) about every 80 cm.It is also necessary to include additi-onal ceiling mountings, one left and one right, in the event of greater weight due to large pendants, e.g. KPM 5000 or KPM 5005. We also wish to point out that with undimmed, and in particular with dimmed toroi-dal transformers, there is a possibility of a humming noise! It is essential to ensure that only LV leading-edge dim-mers are used for dimming of toroidal and conventional transformers, whe-reas electronic transformers should be dimmed only with trailing-edge-dimmers.

Dagegen werden die gewickelten Transformatoren mit Phasen-ANschnitt-Dimmer gedimmt. Allerdings sind eventuell auftretende Brummgeräusche technisch bedingt und deshalb leider unvermeidbar.

Verkaufs- und LieferbedingungenI. GeltungsbereichDiese Verkaufs- und Lieferbedingungen gelten als verbindlich, wenn nicht schriftlich etwas anderes vereinbart ist. Entgegenstehende oder abweichende Bedingungen des Bestellers sind unverbindlich, auch wenn ihnen nicht ausdrücklich widersprochen oder die Lieferung ohne Einspruch gegen entgegenstehende Bedingungen vorgenommen oder Lieferung angenom-men wird.

II. Leistungsumfang und Vertragsabschluß 1. Die abgegebenen Angebote sind freibleibend. Eine Bestellung gilt als angenommen, wenn

dieses schriftlich bestätigt oder Lieferung ausgeführt wird.2. Die durch Handelsvertreter oder Handlungsreisende getroffenen Vereinbarungen oder

mündlichen Absprachen erhalten erst durch unsere schriftliche Bestätigung Rechtsverbind-lichkeit.

III. Lieferfristen1. Der Liefertermin der Auftragsbestätigung ist unverbindlich, sofern schriftlich nicht etwas

anderes ausdrücklich vereinbart ist. Die Frist zur Lieferung verlängert sich bei Eintritt unvor-hergesehener, außergewöhnlicher oder unabwendbarer Ereignisse jedweder Art, insbeson-dere Streiks und ähnlichem, auch bei nicht rechtzeitiger Selbstbelieferung aus Gründen, die wir nicht zu vertreten haben. In solchen Fällen werden wir nach Möglichkeit den Besteller sofort benachrichtigen.

2. Im Falle eines von uns zu vertretenden Lieferverzuges wird der Besteller in jedem Fall eine angemessene Nachfrist gewähren, bevor er Rechte aus dem abgeschlossenen Vertrag geltend macht. Wird die Nachfrist nicht eingehalten, so kann der Besteller je vollendeter Woche weiteren Verzuges Ersatzansprüche bis max. 0,5 % vom Lieferwert geltend machen, insgesamt jedoch max. 5 % des Lieferwertes. Weitergehende Ansprüche jedweder Art sind ausgeschlossen.

IV. Gefahrenübergang Die Lieferung erfolgt grundsätzlich ab Werk auf Gefahr des Empfängers.

V. RücksendungenRücksendungen können nur nach vorheriger schriftlicher Einwilligung vorgenommen werden. Die Rücksendung muss frachtfrei erfolgen. Die anfallenden Bearbeitungskosten im Zusam-menhang mit der Rücksendung, wie z.B. auch Überprüfung, Instandsetzung, Neuverpackung werden in Abzug gebracht. Diese Regelung gilt nicht im Falle des berechtigten Rücktritts vom Vertrag.

VI. Preise und Zahlungsbedingungen1. Alle Preise verstehen sich ab Werk und ohne Umsatzsteuer.2. Bei einem Netto-Auftragswert von wenigstens € 500,- liefern wir innerhalb der BRD franco

Empfänger. Für Einzelbestellungen mit einem Netto-Warenwert von weniger als € 100,- , müssen wir neben den üblichen Verpackungs- und Frachtkosten noch zusätzlich eine Ko-stenbeteiligung von € 6,- berechnen.

3. Bei Bezahlung innerhalb von 10 Tagen nach Rechnungsdatum gewähren wir 2 % Skonto. Der Rechnungsbetrag ist 30 Tage nach Rechnungsdatum ohne Abzug zur Zahlung fällig.

4. Ist der Besteller mit seiner Zahlung in Verzug, so sind wir berechtigt, Verzugszinsen in Höhe von 8 % über dem jeweiligen Basiszinssatz zu berechnen.

VII. Eigentumsvorbehalt1. Wir behalten uns das Eigentum an der Ware bis zum Eingang der Zahlung vor. Insoweit tritt

der Besteller alle Kaufpreisforderungen gegen seine Abnehmer in Höhe unserer Ansprüche an uns ab.

2. Bei vertragswidrigem Verhalten des Bestellers, insbesondere auch bei Zahlungsverzug, sind wir berechtigt, die unter Eigentumsvorbehalt gelieferte Ware zurückzunehmen, ohne dass damit eine Rücktrittserklärung unsererseits vom Vertrag verbunden ist.

VIII. SachmängelFür Sachmängel haftet der Lieferer wie folgt:1. Alle diejenigen Teile oder Leistungen sind nach Wahl des Lieferers unentgeltlich nachzu-

bessern, neu zu liefern oder neu zu erbringen, die innerhalb der Verjährungsfrist – ohne Rücksicht auf die Betriebsdauer – einen Sachmangel aufweisen, sofern dessen Ursache bereits im Zeitpunkt des Gefahrübergangs vorlag.

2. Sachmängelansprüche verjähren in 12 Monaten. Dies gilt nicht in Fällen der Verletzung des Lebens, des Körpers oder der Gesundheit, bei einer vorsätzlichen oder grob fahrläs-sigen Pfl ichtverletzung des Lieferers und bei arglistigem Verschweigen eines Mangels. Die gesetzlichen Regelungen über Ablaufhemmung, Hemmung und Neubeginn der Fristen blei-ben unberührt.

3. Der Besteller hat Sachmängel gegenüber dem Lieferer unverzüglich schriftlich zu rügen.4. Bei Mängelrügen dürfen Zahlungen des Bestellers in einem Umfang zurückgehalten wer-

den, die in einem angemessenen Verhältnis zu den aufgetretenen Sachmängeln stehen. Der Besteller kann Zahlungen nur zurückhalten, wenn eine Mängelrüge geltend gemacht wird, über deren Berechtigung kein Zweifel bestehen kann. Erfolgte die Mängelrüge zu Unrecht, ist der Lieferer berechtigt, die ihm entstandenen Aufwendungen vom Besteller ersetzt zu verlangen.

5. Zunächst ist dem Lieferer Gelegenheit zur Nacherfüllung innerhalb angemessener Frist zu gewähren.

6. Schlägt die Nacherfüllung fehl, kann der Besteller – unbeschadet etwaiger Schadenersatz-ansprüche gemäß Art. IX - vom Vertrag zurücktreten oder die Vergütung mindern.

7. Mängelansprüche bestehen nicht bei nur unerheblicher Abweichung von der vereinbar-ten Beschaffenheit, bei nur unerheblicher Beeinträchtigung der Brauchbarkeit, bei natür-licher Abnutzung oder Schäden, die nach dem Gefahrübergang infolge fehlerhafter oder nachlässiger Behandlung, übermäßiger Beanspruchung, ungeeigneter Betriebsmittel, mangelhafter Bauarbeiten, ungeeigneten Baugrundes oder die aufgrund besonderer äu-ßerer Einfl üsse entstehen, die nach dem Vertrag nicht vorausgesetzt sind, sowie bei nicht reproduzierbaren Softwarefehlern. Werden vom Besteller oder von Dritten unsachgemäß Änderungen oder Instandsetzungsarbeiten vorgenommen, so bestehen für diese und die daraus entstehenden Folgen ebenfalls keine Mängelansprüche.

8. Ansprüche des Bestellers wegen der zum Zweck der Nacherfüllung erforderlichen Aufwen-dungen, insbesondere Transport-, Wege-, Arbeits- und Materialkosten, sind ausgeschlos-sen, soweit die Aufwendungen sich erhöhen, weil der Gegenstand der Lieferung nachträg-lich an einen anderen Ort als die Niederlassung des Bestellers verbracht worden ist, es sei denn, die Verbringung entspricht seinem bestimmungsgemäßen Gebrauch.

9. Rückgriffsansprüche des Bestellers gegen den Lieferer gemäß § 478 BGB (Rückgriff des Unternehmers) bestehen nur insoweit, als der Besteller mit seinem Abnehmer keine über die gesetzlichen Mängelansprüche hinausgehenden Vereinbarungen getroffen hat. Für den Umfang des Rückgriffsanspruchs des Bestellers gegen den Lieferer gemäß § 478 Abs. 2 BGB gilt Nr. 8 entsprechend. Als Ausgleich im Sinne des § 478 Abs. 4 Satz 1 BGB für den Ausschluss der dort genannten Mängelgewährleistungsrechte gewährt der Lieferer pau-schal Skonto und Zahlungsziele gemäß obiger Regelung (VI Ziffer 3).

10. Für Schadenersatzansprüche gilt im Übrigen Art. IX (Sonstige Schadenersatzansprüche). Weitergehende oder andere als die in diesem Art. VIII geregelten Ansprüche des Bestellers gegen den Lieferer und dessen Erfüllungsgehilfen wegen eines Sachmangels sind ausge-schlossen.

IX. Sonstige Schadensersatzansprüche1. Schadens- und Aufwendungsersatzansprüche des Bestellers (im Folgenden: Schadenser-

satzansprüche), gleich aus welchem Rechtsgrund, insbesondere wegen Verletzung von Pfl ichten aus dem Schuldverhältnis und aus unerlaubter Handlung, sind ausgeschlossen.

2. Dies gilt nicht, soweit zwingend gehaftet wird, z.B. nach dem Produkthaftungsgesetz, in Fällen des Vorsatzes, der groben Fahrlässigkeit, wegen der Verletzung des Lebens, des Körpers oder der Gesundheit, wegen der Verletzung wesentlicher Vertragspfl ichten. Der Schadensersatzanspruch für die Verletzung wesentlicher Vertragspfl ichten ist jedoch auf den vertragstypischen, vorhersehbaren Schaden begrenzt, soweit nicht Vorsatz oder grobe Fahrlässigkeit vorliegt oder wegen der Verletzung des Lebens, des Körpers oder der Ge-sundheit gehaftet wird. Eine Änderung der Beweislast zum Nachteil des Bestellers ist mit den vorstehenden Regelungen nicht verbunden.

3. Soweit dem Besteller nach diesem Art. IX Schadensersatzansprüche zustehen, verjähren di-ese mit Ablauf der für Sachmangelansprüche geltenden Verjährungsfrist gemäß Art. VIII Nr. 2. Bei Schadensersatzansprüchen nach dem Produkthaftungsgesetz gelten die gesetzlichen Verjährungsvorschriften.

X. Gerichtsstand1. Gerichtsstand für alle Ansprüche – ohne Rücksicht auf die Höhe des Streitwertes – ist

das Amtsgericht in 59821 Arnsberg. Dieses gilt auch für Ansprüche, die im Mahnverfahren verfolgt werden. Wir behalten uns jedoch vor, den Besteller auch an dem für seinen Sitz zuständigen Gericht zu verklagen.

2. Es gilt – auch für Exportverträge – deutsches Recht als vereinbart.

Confl icting or differing terms of the purchaser are not binding, even if no objection has been explicitly made to them or if the delivery is made or is accepted without objection to the confl icting term.

II. Scope of services and conclusion of contract 1. Quotations issued are subject to change. An order is considered as accepted when confi r-

med in writing or when delivery takes place.2. Agreements made with sales agents or commercial travellers or verbal agreements do not

become legally binding until our written confi rmation is issued.

III. Delivery deadlines1. The delivery date shown on the Order Confi rmation is without obligation unless other ag-

reements are explicitly made in writing. The delivery period is extended should unforeseen, unusual or inevitable incidents of any kind occur, in particular strikes and similar incidents, also in the event of delayed self-supply for reasons we are not accountable for. In such cases we will inform the purchaser immediately whenever possible.

2. Should a delivery delay occur for which we are accountable, the purchaser will grant us an adequate period of grace before asserting his rights according to the contract concluded. If this period of grace is not met, the purchaser can claim compensation up to max. 0.5% of the delivery value for each full week of further delay, however, in total max. 5% of the delivery value. Extensive compensation of any kind whatsoever is excluded.

IV. Transfer of risk Delivery is made generally on the basis ex works at the risk of the consignee.

V. Return of goodsGoods may be returned only after prior written agreement. Goods must be returned carriage prepaid. Subsequent handling costs related to the return, e.g. inspection, repair, re-packing, will be deducted. This provision does not apply in the event of justifi ed termination of the contract.

VI. Prices and payment terms1. All prices are ex works excluding VAT.2. For an order value of min. € 500 net we deliver carriage paid within FRG. For individual

orders with an order value of less than € 100 net we will invoice a handling charge of€ 6 in addition to the usual costs for packing and freight.

3. For payment within 10 days of invoice date we grant 2 % discount. The amount invoiced is due in full 30 days after invoice date.

4. If the purchaser is in arrears with payment, we are entitled to charge interest payable on arrears of 8 % above the respective base lending rate.

VII. Retention of title1. We retain title to the goods until receipt of payment in full. In this regard the purchaser

shall assign to us all sales claims towards his customers to the value of our claims.2. In the event of behaviour contrary to the contract on the part of the purchaser, in particular

in the event of payments in arrears, we are entitled to recover the goods supplied under condition of retention of title, nor does this represent a cancellation of the contract from our part.

VIII. Terial damageThe supplier accepts liability for material damage as follows:1. All parts or services shall be repaired, replaced or provided anew, free of charge, at the

supplier’s discretion, when showing material damage within the period of limitation for warranty claims – regardless of operation hours – provided the damage had already been caused at the point of time of transfer of risk.

2. Claims for material damage are time barred after the expiry of 12 months. This does not apply in the event of injury to life, body or health, in the event of a wilful or grossly negli-gent breach of duty on the part of the supplier and in the event of fraudulent concealment of damage. Legal provisions governing suspension, interruption and delay to expiry remain unaffected.

3. The purchaser shall give immediate written notice of material defects to the supplier.

4. In the event of notice of a defect the purchaser is entitled to withhold payments in rea-sonable proportion to the amount of material damage that has occurred. The purchaser can only withhold payments if a claim is made and its validity is beyond doubt. Should an unjustifi able claim be made, the supplier is entitled to demand compensation from the purchaser for expenditure that has occurred.

5. The supplier shall fi rst be given the opportunity for subsequent performance within an appropriate period.

6. Should the subsequent performance fail, the purchaser is entitled – regardless of any claims for damages under Provision IX – to withdraw from the contract or reduce the payment amount.

7. Warranty rights do not exist if there is only slight deviation from the agreed appearance and workmanship, if there is only insignifi cant impairment of serviceability, in the event of natural wear and tear or damage that has occurred after the transfer of risk due to im-proper or negligent treatment, excessive wear, unsuitable equipment, defective construc-tion work, inappropriate construction sites or that has arisen due to particular external infl uence that is not presupposed in the contract, as well as software errors that are not reproducible. Should inappropriate modifi cations or repairs be made by the purchaser or third parties, no warranty rights apply for these or for their consequences.

8. Claims asserted by the purchaser due to costs, in particular freight, transport, work and material costs resulting from subsequent performance, are excluded insofar as the costs in-crease as the object of delivery has subsequently been brought to a destination other than the place of business of the purchaser, with the exception that the transfer corresponds to its intended use.

9. Recourse rights of the purchaser against the supplier according to § 478 German Civil Code (recourse of a company) exist only insofar as the purchaser has made no agreement with his buyer above and beyond the legal warranty rights. For the extent of the recourse claim of the purchaser against the supplier in accordance with § 478 Section 2 German Civil Code no. 8 applies accordingly. As compensation in the sense of § 478 Section 4 Clause 1 German Civil Code the supplier grants overall discount and payment terms in accordance with the above regulation (VI Clause 3) for the exclusion of the warranty rights named therein.

10. For other claims for damages Provision IX applies (Sundry Claims for Damages). Further claims or claims other than the claims of the purchaser against the supplier and his perfor-mance aids arising from material damage, governed in this Provision VIII, are excluded.

IX. Sundry claims for damages1. Claims for damages and costs asserted by the purchaser (hereinafter: Claims for damages),

irrespective of their legal basis, in particular on the grounds of breach of duty from contrac-tual obligation and claims in tort, are excluded.

2. This does not apply insofar as liability is mandatory e.g. according to the Product Liability Act, in cases of deliberate intention, of gross negligence, due to injury to life, body or health, due to breach of signifi cant contractual obligations. Damage claims for breach of signifi cant contractual obligations is however limited to damages foreseeable and contract coherent, insofar as intent or gross negligence are not given or liability due to injury to life, body or health is not applied. A change of the burden of proof to the disadvantage of the purchaser is not connected to the preceding provision.

3. As far as the purchaser is entitled to damages arising from a claim in accordance with this Provision IX, these shall be time barred on expiry of the effective time bar for material damage claims according to Provision VIII no. 2. For claims for damages in accordance with the Product Liability Act, the legal time bar regulations apply.

X. Place of Jurisdiction1. The exclusive place of jurisdiction – irrespective of the amount in dispute – is the district

court in 59821 Arnsberg. This applies also for claims asserted through enforcement procee-dings. We however reserve the right to fi le suit against the purchaser with any other court having jurisdiction over the purchaser.

2. German law is agreed applicable – also for export agreements.
