Topics of the responsum

The Gaon is asked three questions pertaining to a divorced woman whose husband does not have the

means to pay the money due her from her marriage contract (ketubba), and she therefore claims from

a guarantor. The marriage contract was written on the intermediate days of the festival (when the

writing of such contracts if forbidden). The questions are as follows:

A. Whether the payment of two-hundred owed to a woman who marries as a virgin and the

payment of one-hundred owed to a widow is evaluated in Tyrian1 currency or the provincial

currency.2

B. Whether in this case we are concerned that the husband has already partially paid that which

he owed from the marriage contract, and that therefore the guarantor would be absolved from

paying the woman.

C. Whether the woman should be punished and have the value of her marriage contract reduced

given that the marriage contract was written on the intermediate days of the festival.3

In his response the Gaon appears to establish the value of the marriage contract according to the

custom of the Land of Israel – Tyrian currency; in answer to the second question the Gaon responds

that the husband must to cut off his wife from the benefits of his property;4 in response to the question

of whether the wife can be fined for being involved in the transgression of the marriage contract being

written on the intermediate days of the festival, the Gaon responds that despite the fact we do not mix

The responsum was printed by Assaf, Gaonica, 97. The letter to which the responsum was attached

was printed by Goitein, Ha-yishuv, 91-96, and again by Gil, Land of Israel, vol 2, no. 83, 154 n. 34.

According to Goitein the letter was sent from Solomon b. Judah al Sahalan b. Abraham (the leader of

the Babylonian community in al-Fustat, in Tevet (December) 1029 CE (on the dating considerations,

see Goitein, ibid 91). Gil, on the other hand, suggests identifying the addressee with Abraham

HaCohen b. Isaac. At line 50 (Goietin, 96; Gil, 154), it states ‘and the answer to your question appears

in the letter to your father’. Goitein concludes that the answer alluded to here is the same as the

answer above. The responsum also expresses thanks for the care given to Abraham, the son of the

Gaon.

Yerushalmi Kettubot 1:2, 25a records a dispute between Huna in the name of Shmuel and R. Ba

bar Bina over whether the two hundred [zuzim] owed to the virgin and the one hundred [zuzim] of the

widow are payable in the shekel of the sanctuary (i.e. two hundred dinars) or in the currency

circulating, i.e. the local currency, which is equivalent to 1/8th of the Tyrian coin, thus amounting to a

total of 25 dinars of Tyrian currency.

867. On the second line the responder mentions R. Natronai Gaon. Gil (Palestine, II, no. 160, n. 2)

suggests that the responder is referring to the responsum of R. Natronai that ‘a man does not engage in

illicit sexual intercourse’. He relies on the different versions in O5ar ha-Geonim on Yevamot, pp. 38–

42.

References in Responsa: ‘the bakers in the court of Prague’ were evidently mentioned within the

framework of a discussion regarding the prohibition against ‘bread of non-Jews’ (nowadays known as

‘pat akum’), and the respondent deliberated over whether the bread they baked was kosher; Ramla.

Question posed to R. Daniel Gaon concerning commerce in Sicily. The content of the question is very

unclear, and the full meaning cannot be fully understood; the question appears to deal with the

division of profits (or the bearing of losses) from a business venture. Within the context of the

question the contractual agreement between the sides is quoted.

Content notes: A similar question regarding an agreement between an Egyptian merchant and a

Sicilian one appears in Oxford, Bodleian MS. Heb. a. 3.9 (MS 2873 in the Neubauer-Kaoli Catalog;

Assaf, Gaonic Responsa, pp. 125-127). There, however, it notes that ‘the formulator will formulate

the deed letter by letter,’ and Assaf, p. 126, n. 7, states that ‘the meaning is that the copier will attach

to the question the text of the document.’ It appears that the Oxford manuscript is a draft, whereas the

manuscript before us is the full question which was sent to the Gaon, which also included the text of

the agreement, of which only the first lines survived. The document is mentioned by Gil, Palestine, 1,

p. 450, n. 776 (and following him, Ben Sasson, The Jews of Sicily, p. 639); Cohen, Jewish Self-

Government, p. 97, n. 22.

Content notes: The reponsum was printed by Assaf, Gaonica, 93-97. It is also mentioned by Gil,

Palestine, 1, p. 146 Para. 285; p. 414, Para, 738; p. 426 Para. 753. Before the responsum, there is an

end of a letter, evidently one of consolation regarding a man who had been killed by the authorities.

The letter was printed by Assaf (ibid., pp. 92-93, lines 1-21), and was not cited here. From reading

Assaf, it appears that the condition of the manuscript was in a better position than it is today – today

the manuscript is blurry and faded, and many words which Assaf had read are not clear today. We

attempted to preserve Assaf’s reading where this was possible based on the manuscript before us, and

in those places where we did not seen the letters, or where remnants of the letters remained, we

printed them enclosed them in curly brackets.

The handwriting of this manuscript resembles that of Mosseri III.234.

A portion of a responsum[?]. The condition of the fragment does not allow for absolute clarity as to

the subject under discussion. Yet it appears that the responsum deals with monetary law. The word

‘asirit (‘tenth’, lines 21 and 23) may refer to a tenth of an amount or a certain property. The discussion

may concern ‘asirit nekhasin, the tenth of the estate that a daughter receives from her father’s estate

upon his death for the purposes of her upkeep. The mention of ‘the orphan’ (side two, verso line 4),

adds weight to the impression that the topic of the fragment does indeed concern laws of inheritance.

This must remain, however, only an assumption.

Fustat (Jewish Leadership, p. 257; Jews of Egypt, p. 207). 60 He was in contact with the Palestinian

Geonim (Jewish Leadership, pp. 100–121). Letters to and from him are published in Bareket’s Jews of

Egypt, but this letter is not published there
