BACKGROUND

The “Deutsch-Syrischer Verein zur Förderung der Freiheiten und Menschenrechte e.V.” (short: DSV) is a registered non-profit Organisation in Germany. DSV was founded in 2011 by Syrians, Germans and Germans of Syrian origin to provide assistance and support to refugees and displaced persons from Syria. The head office is located in Darmstadt, Germany.

Politically, ideologically and denominationally unaffiliated, we are as a registered non-profit organization active in all areas, where help is urgently needed.

Since more than four years we provide humanitarian relief, emergency and medical assistance. The focus especially in the medical field. Due to our good contacts of members to Syrians, who live in Syria or in the border areas, the need for humanitarian aid and medical devices can be accurately determined. A trusted network in Syria and the neighbouring countries guarantees that the aid gets to where it is actually needed – people in need, injured, ill and disabled people.

The DSV is committed to the principles of human rights: - humanity - impartiality - independence - voluntary - unity and universality The focus of our work is the humanitarian emergency in Syria. Since 20011 we support the refugees and displaced persons in Syria and the neighboring countries and recently in Germany. We are committed to maintaining an intensive medical care and ensuring the hospital operation in Syria. In addition to helping orphans, we assist Syrian families in need in raising their livelihood. Increasingly the DSV turned towards traumatized Syrian refugees. Regularly we organize training for psychologists and psychotherapists from the war region to provide adequate psychosocial support for the war victims.

INTRODUCTION Due to the escalating conflict in Syria the health care system is totally inadequate. In response the DSV supports several health centres and hospitals in Syria. For more than five years DSV has been working for the maintenance of medical care in Syria. The DSV supports the construction of hospitals and provides medical equipment. DSV supplies medicine, drugs and medical equipment’s to selected health facilities inside Syria. This aid is to be performed as a cross-border operation from neighbouring countries. The hospital operation can be maintained and health facilities can offer health services free of charge. DELIVERY DETAILS

2. Bids must be delivered to the above address on or before

3. Your quotation(s) should be submitted as per the following instructions and in

accordance with the Terms and Conditions of supply in the attached draft

Purchase Order.

4. Offers determined to be substantially responsive to the technical specifications

will be evaluated by comparison of their prices.

5. The award will be made to the firm offering the lowest evaluated price and that

meets the required standards of technical specifications.

6. Your quotation should be valid for a period of 90 days from the date of receipt

for quotation.

Instruction to Bidders

1. This bid is opened to all qualified and registered suppliers.

2. The suppliers should be specialised in the scope of the bid, medicine,

drugs and medical equipment.

3. The supplier is expected to furnish all information required by the request

for quotation

4. The bidder can put more than one model/type and price for the same item.

5. Provide the invoice in English in the name of Deutsch Syrischer Verein zur

Förderung der Freiheiten und Menschenrechte e.V. (DSV) and the agreed

amount.

6. Goods must exclude TAX and should be delivered duty paid (DDP/DAP) to

defined destinations inside Syria.

7. DSV has the right to reject any item that does not agree with the

specifications.

8. A prospective supplier requiring clarification shall request such clarification

from the purchaser in writing by mail, no later than three days before the

Deadline for submission.

9. The prices should be quoted by the supplier in Euro (€).

10. The prices are set of all the items in the bill of quantities, to include the

value of the item, the work of the preparations, taxes, profits and

compensation for any other obligations borne by the bidder pursuant to this

contract.

11. The contract price shall be fixed and not subject to any price adjustments.

12. Supply of all required material within the specified condition and

framework.

13. All materials and equipment shall be securely packed in crates or boxes for

protection against damage during transport.

14. DSV does not bind to the lowest price.

15. Award will be made to the lowest evaluated responsive bidder whose

goods meet the specifications and who has the necessary capability to

carry out the contract satisfactorily.

16. DSV may increase or decrease the total quantity or partly quantities

depending on project fund availability.

15 calendar days after contract signature.

21. The pay methodology:

22. The service provider undertakes to comply with all applicable laws and to

ensure that it does not engage in any kind of criminal activity including but

not limited to bribery, fraud, corruption, terrorism and to maintain ethical

Bid Conditions

• Prices shall include transporting and delivery cost, taxes, fees and expenses

to the place of destination.

• In case of discrepancy between unit price and total derived from unit price, unit

price shall prevail.

• Fixed Price; the prices indicated are firm and fixed and not subject to any

adjustment during contract performance.

• Quantity: The Purchaser may increase or decrease the total quantity or partly

quantities depending on project fund availability without seeking for approval

from the Supplier.

• Delivery Schedule: The delivery should be completed as per above mentioned

by supplier or according to the contract after that.

• Delivery Destination: The delivery should be completed at the following

address:

• Payment: Payment of the contract price shall be made in Euro (€).

• Failure to Perform: The Purchaser may cancel the Purchase Order if the

Supplier fails to deliver the supplies, in accordance with the above terms and

conditions, in spite of being given 7 days’ notice by the Purchaser, without

incurring any liability to the Supplier.

• Liquidated damages: Timely delivery is the essence of this contract. The

Supplier shall pay liquidated damages to the Purchaser at the rate per week

1% of the final contract price for each week that the Completion Date is later

than the Intended Completion Date.

The total amount of liquidated damages shall not exceed the amount 10% of

the final contract amount, provided always that the delay is not attributable to

any action of the Purchaser or a “force majeure” situation. The Purchaser may deduct liquidated damages from payments due to the Contractor.

Payment of liquidated damages shall not affect the Contractor’s liabilities. The Purchaser has the right to terminate the contract in case the total amount

of liquidity damages equals 10% of the final contract price.

Performance Security: Within 3 days from the date of receiving the notification

of award, the successful Bidder shall sign the contract.

Force Majeure: the following events may be treated as “force majeure” situations:

o Acts of Purchaser in its sovereign capacity

o Wars of revolutions.

o Major fires in suppliers/manufacturers facilities

o Major epidemics

o Freight embargoes

o Civil strife in the manufacturers/ suppliers country

In the event of a “force majeure” the supplier will promptly inform the Purchaser (in writing) of such a situation and specifically indicate how the

situation would affect the performance. The Purchaser and Supplier will then

mutually agree on alternative means of performance.
