(2) Bene f ts paid under this chapter shall not count toward thefederal 60-month time limit on aid as set forth in Section

608(a)(7)(A) of Title 42 of the United States Code. Payment of WINS bene f ts shall not commence before October 1, 2012 2013 ,and full implementation of the program shall be achieved on orbefore April 1, 2013 2014 .

(f) (1) Notwithstanding the rulemaking provisions of theAdministrative Procedure Act (Chapter 3.5 (commencing withSection 11340) of Part 1 of Division 3 of Title 2 of the GovernmentCode and Section 10554), until emergency regulations are f ledwith the Secretary of State pursuant to paragraph (2), the StateDepartment of Social Services may implement this section throughall-county letters or similar instructions from the director. Thedirector may provide for individual county phase-in of this sectionto allow for the orderly implementation based upon standardsestablished by the director, including the operational needs andrequirements of the counties. Implementation of the automationprocess changes shall include issuance of an all-county letter orsimilar instructions to counties by March 1, 2012 2013 .

(2) The department may adopt regulations to implement thischapter. The initial adoption, amendment, or repeal of a regulationauthorized by this section is deemed to address an emergency, forpurposes of Sections 11346.1 and 11349.6 of the GovernmentCode, and the department is hereby exempted for that purposefrom the requirements of subdivision (b) of Section 11346.1 of the Government Code. After the initial adoption, amendment, orrepeal of an emergency regulation pursuant to this paragraph, thedepartment may request approval from the Of f ce of AdministrativeLaw to readopt the regulation as an emergency regulation pursuantto Section 11346.1 of the Government Code.

(g) (1) The department shall not fully implement this sectionuntil the department convenes a workgroup of advocates, legislativestaff, county representatives, and other stakeholders to considerthe progress of the WINS automation effort in tandem with apre-assistance employment readiness system (PAERS) programand any other program options that may provide offsetting bene f ts

to the caseload reduction credit in the CalWORKs program. Thedepartment shall convene this workgroup on or before December1, 2011 2012 .

(2) A PAERS program shall be considered in light of currentand potential federal Temporary Assistance for Needy Families(TANF) statutes and regulations and how other states with

pre-assistance or other caseload offset options are responding tofederal changes.(3) The consideration of program options shall include, but not

necessarily be limited to, the potential impacts on helping clientsto obtain self-suf f ciency, increasing the federal work participationrate, increasing the caseload reduction credit, requirements andef f ciency of county administration, and the well-being of CalWORKs recipients.

(4) If the workgroup concludes that adopting a PAERS programor other program option pursuant to this section would, on balance,be favorable for California and its CalWORKs recipients, thedepartment, in consultation with the workgroup, shall prepare aproposal by March 31, 2012 2013 , for consideration during theregular legislative budget subcommittee process in 2012 2013 .

(5) To meet the requirements of this subdivision, the departmentmay use its TANF reauthorization workgroups.

SEC. 40. Section 17021 of the Welfare and Institutions Codeis amended to read:

17021. (a) Any individual who is not eligible for aid underChapter 2 (commencing with Section 11200) of Part 3 as a resultof the 48- or 60-month limitation speci f ed in subdivision (a) of Section 11454 shall not be eligible for aid or assistance under thispart until all of the children of the individual on whose behalf aidwas received, whether or not currently living in the home with theindividual, are 18 years of age or older.

(b) Any individual who is receiving aid under Chapter 2(commencing with Section 11200) of Part 3 on behalf of an eligiblechild, but who is either ineligible for aid or whose needs are nototherwise taken into account in determining the amount of aid tothe family pursuant to Section 11450 due to the imposition of asanction or penalty, shall not be eligible for aid or assistance underthis part.

(c) This section shall not apply to health care bene f ts providedunder this part.

SEC. 41. Notwithstanding any other law, and except asotherwise speci f ed in this act, Sections 5 to 7, inclusive, and 9,15, 26, 29, and 40, shall become operative on the f rst day of thef rst calendar month following 90 days after the effective date of this act or June 1, 2011, whichever is later, unless the amended or added section speci f es a date on which the section becomes

operative.SEC. 42. (a) Notwithstanding the rulemaking provisions of the Administrative Procedure Act (Chapter 3.5 (commencing withSection 11340) of Part 1 of Division 3 of Title 2 of the Government Code), the department may implement and administer the changesto Sections 11265.2, 11266.5, 11320.15, 11320.3, 11322.63,11323.25, 11450, 11450.02, 11450.025, 11451.5, 11454, 11454.5,12309.1, and 17021 of the Welfare and Institutions Code, ascontained in this act, through all-county letters or similar instructions from the department until regulations are adopted.The department shall adopt emergency regulations implementingthese provisions no later than July 1, 2012. The department mayreadopt any emergency regulation authorized by this section that is the same as or substantially equivalent to an emergencyregulation previously adopted under this section.

(b) The initial adoption of emergency regulations pursuant tothis section and one readoption of emergency regulations shall bedeemed an emergency and necessary for the immediatepreservation of the public peace, health, safety, or general welfare.Initial emergency regulations and the one readoption of emergencyregulations authorized by this section shall be exempt from reviewby the Of f ce of Administrative Law. The initial emergencyregulations and the one readoption of emergency regulationsauthorized by this section shall be submitted to the Of f ce of Administrative Law for f ling with the Secretary of State and eachshall remain in effect for no more than 180 days, by which timef nal regulations may be adopted.

SEC. 43. If any portion of this act is held unconstitutional or unenforceable by a court of law, that decision shall not affect thevalidity of any other portion of this act. The Legislature herebydeclares that it would have passed this act, and each portionthereof, irrespective of the fact that any other portion be declared unconstitutional or unenforceable.

SEC. 44. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement tolocal agencies and school districts for those costs shall be madepursuant to Part 7 (commencing with Section 17500) of Division4 of Title 2 of the Government Code.

SEC. 45. The sum of one thousand dollars ($1,000) is hereby

appropriated from the General Fund to the State Department of Social Services for administration.SEC. 46. This act addresses the f scal emergency declared and

reaf f rmed by the Governor by proclamation on January 20, 2011,pursuant to subdivision (f) of Section 10 of Article IV of theCalifornia Constitution.

SEC. 47. This act is a bill providing for appropriations related to the Budget Bill within the meaning of subdivision (e) of Section12 of Article IV of the California Constitution, has been identi f ed as related to the budget in the Budget Bill, and shall take effect immediately.

SEC. 48. This act is an urgency statute necessary for theimmediate preservation of the public peace, health, or safety withinthe meaning of Article IV of the Constitution and shall go intoimmediate effect. The facts constituting the necessity are:

In order to make changes necessary for implementation of theBudget Act of 2011, it is necessary for this act to take effect immediately.

SECTION 1. It is the intent of the Legislature to enact statutorychanges relating to the Budget Act of 2011.
