Schutzrechte und Nutzungsu mfangDie Datei Ihrer Wahl unterliegt Schutzbestim-mungen. Festo oder Dritte haben Schutzrechtean dieser Elektronischen Dokumentation. So-weit die Rechte Dritten zustehen, hat Festoentsprechende Nutzungsrechte. Festo gestattetdem Verwender die Nutzung unter den folgen-den Voraussetzungen:

1. Nutzungsumfanga) Der Verwender der Elektronischen Doku-

mentation ist berechtigt, diese für eigene,ausschließlich betriebsinterne Zwecke aufbeliebig vielen Maschinen innerhalb seinesBetriebsgeländes (Einsatzort) zu nutzen.Dieses Nutzungsrecht umfaßt ausschließ-lich das Recht, die Elektronische Dokumen-tation auf den am Einsatzort eingesetztenZentraleinheiten (Maschinen) zu speichern.

b) Die Elektronische Dokumentation darf amEinsatzort des Verwenders in beliebigerZahl über einen Drucker ausgedruckt wer-den, sofern dieser Ausdruck vollständig mitdiesen Nutzungsvereinbarungen und sonsti-gen Benutzerhinweisen ausgedruckt bzw.verwahrt wird.

c) Mit Ausnahme des Festo-Logos ist der Ver-wender berechtigt, Bilder und Texte derElektronischen Dokumentation zur Erstel-lung eigener Maschinen- und Anlagendoku-mentation zu verwenden. Die Verwendungdes Festo-Logos bedarf der schriftlichenGenehmigung von Festo. Für die Überein-stimmung genutzter Bilder und Texte mit

Proprietary rights and scope of useThe file of your choice is subject to proprietaryrights. Festo or third parties hold proprietaryrights in respect of this electronic documenta-tion. Insofar as the rights are granted to thirdparties, Festo has acquired the appropriatelicences. Festo grants the purchaser the rightof use under the following conditions:

1. Scope of usea) The user of the electronic documentation

has the right to use this only for his owninternal purposes on as many machines asdesired within his business location (site).This right of use includes only the right tostore the electronic documentation on thecentral processing units (machines) on thesite in question.

b) The electronic documentation may beprinted to any desired extent at the user’ssite, providing this copy is printed com-pletely with the conditions of use and otheruser instructions.

c) With the exception of the Festo logo, theuser has the right to use illustrations andtexts in the electronic documentation forcreating his own machine and system documentation. The use of the Festo logorequires the written permission of Festo.The user himself is responsible for ensur-ing that both the illustrations and the texts

d) Further use is permitted within the followinglimits. Copying exclusively for use within the frame-work of machine and system documenta-tion based on electronic documents of allthe documented supplier components.

Demonstrations to third parties exclusivelywith the assurance that no data materialremains completely or partly in other net-works or on another data medium or that itcan be reproduced there.

The transfer of copies and printouts to thirdparties, except as defined in Section 3below, as well as any other processing oruse is not permitted.

2. Copyright noticeEvery "electronic documentation" contains a copyright notice. This notice must be includedin all copies and in all printouts.

3. Transfer of licenceThe user may transfer his/her licence to a thirdparty subject to the scope of use and restric-tions as defined in sections 1 and 2. The thirdparty must be expressly made aware of theseconditions.

Exporting the electronic documentationIf exporting the electronic documentation, thelicencee is required to observe the export regu-lations of the Federal Republic of Germany andthose of the country to which the electronic do-cumentation is being sent.

Guarantee1. Festo products are developed further as

regards their hardware and software. Thestatus of the hardware and software in theproduct can be seen on the type plate ofthe product. Festo does not guarantee thatthe electronic documentation correspondsto each hardware and software status ofthe product. The printed Festo documenta-tion accompanying the product is decisivefor the correspondance of the hardwareand software status of the product and theelectronic documentation.

2. The information contained in this electronicdocumentation may be amended by Festowithout prior notice and does not representany commitment by Festo.

Liability/Limitation of liability1. Festo provides this electronic documenta-

tion in order to assist the user in creatinghis own machine and system documenta-tion.

technisch weiterentwickelt. Der Hard- undggf. der Software-Stand des Produkts istdem Typenschild des Produkts zu entneh-men. Festo gewährleistet nicht, daß dieElektronische Dokumentation mit jedemHard- und Software-Stand des Produkts übereinstimmt. Maßgeblich für den überein-stimmenden Hard- und Software-Stand vonProdukt und Elektronischer Dokumentationist die dem Produkt beiliegende gedruckteDokumentation von Festo.

2. Die in dieser Elektronischen Dokumentationenthaltenen Informationen können vonFesto ohne Vorankündigungen geändertwerden, und stellen keine Verpflichtung sei-tens Festo dar.

Haftung-/Haftungsbeschränkungen1. Festo stellt diese Elektronische Dokumenta-

Festo does not guarantee that the electro-nic documentation supplied corresponds tothe product used by the user. The latter applies also to the use of extracts for theuser’s own documentation.

2. Festo is also not liable for lack of economicsuccess or for damages or claims fromthird parties, with the exception of claimsarising from violation of the protective rightsof third parties concerning the use of theelectronic documentation.

3. The limitations of liability specified in para-graphs 1 and 2 do not apply in cases ofmalice aforethought or gross negligencewhere liability is compulsory. In such ca-ses, Festo’s liability is limited to the dam-ages recognizable to Festo based on thesituation at hand.

Safety regulations/DocumentationThe guarantee and liability claims specifiedabove (sections III and IV) only apply if theuser has observed the safety regulations in thedocumentation and the safety regulations re-garding the use of the machine. The user isresponsible for ensuring the compatibility of theelectronic documentation with the machine heis using.

Festo gewährleistet jedoch nicht, daß diegelieferte Elektronische Dokumentation mitdem vom Verwender genutzten Produkt übereinstimmt. Letzteres gilt insbesonderebei auszugsweisem Gebrauch für eigeneDokumentationen des Verwenders.

2. Festo haftet ferner nicht für mangelnden wirtschaftlichen Erfolg oder für Schädenoder Ansprüche Dritter, mit Ausnahme vonAnsprüchen aus der Verletzung von Schutz-rechten Dritter, die die Nutzung der Elektro-nischen Dokumentation betreffen.

3. Die Haftungsbeschränkungen nach Absatz1. und 2. gelten nicht, soweit in Fällen vonVorsatz oder grober Fahrlässigkeit oderFehlen zugesicherter Eigenschaften einezwingende Haftung besteht. In einem sol-chen Fall ist die Haftung von Festo auf denjenigen Schaden begrenzt, der fürFesto nach der Kenntnis der konkreten Umstände erkennbar war.

Sicherheitsrichtlinien/DokumentationGewährleistungs- und Haftungsanspruch nachMaßgabe der vorstehenden Regelungen (Ziff.III. u. IV) sind nur gegeben, wenn der Anwen-der die Sicherheitsrichtlinien der Dokumentati-on im Zusammenhang mit der Nutzung derMaschine und deren Sicherheitsrichtlinien be-achtet hat. Für die Kompatibilität der Elektroni-schen Dokumentation mit dem vom Anwendergenutzten Produkt ist der Anwender selbst ver-antwortlich.
