VERWALTUNGSRATBericht über die 10. Tagung desVerwaltungsrats derEuropäischenPatentorganisation(9. bis 11. Dezember 1980)Der Verwaltungsrat der EuropäischenPatentorganisation hat seine 10. Tagungunter dem Vorsitz von Herrn G.VIANES (Frankreich) vom 9. bis 11.Dezember 1980 in München abge-halten.Nach Ablauf des Mandats von Herrn P.BRAENDLI (Schweiz) hat der Rat HerrnR. RAUX (Belgien) für drei Jahre zumVizepräsidenten gewählt.

I Arbeitsweise des EuropäischenPatenta mtsDer Präsident des Amtes, Herr J. B. VANBENTHEM, hat dem Rat seinen Berichtüber die Tätigkeit des Amts seit derletzten Tagung vorgelegt.

Die Zahl der im Jahr 1980 eingereichtenAnmeldungen dürfte bei 19 000 ein-schließlich 2000 Euro-PCT-Anmel-dungen liegen. Diese Anmeldungen ver-teilen sich auf folgende Gebiete derTechnik:

Chemie : 36%. Mechanik: 36%, Physikund Elektrotechnik: 28%.Der Rat hat einen Bericht des Haushalts-und Finanzausschusses und der Arbeits-gruppe "Statistik" entgegengenommen.Ein großer Teil der auf dieser Tagung ge-führten Beratungen war der Genehmigungdes Haushaltsplans der Organisation für1981 sowie des Finanzplans für dieJahre 1982 bis 1985 gewidmet.

Nach Stellungnahme des Haushalts-und Finanzausschusses hat der Ratden Haushaltsplan der Organisation für1981 in Einnahmen und Ausgaben auf194 446 000 DM festgestellt.Der Rat hat einen Beschluß zur Festset-

VIANES(France) in the chair, from 9 to 11December 1980.On the expiry of the term of office of MrP. BRAENDLI (Switzerland). the Councilelected Mr R. RAUX (Belgium) Vice-Chairman for a period of three years.

I Functioning of the EuropeanPatent OfficeMr J. B. Van Benthem, President of theOffice, gave the Council his report on theactivities of the Office since the lastmeeting.

The number of applications filed in 1980is expected to be in the region of 19 000,including 2 000 Euro-PCT applications.Their distribution among the fields oftechnology is as follows:

chemistry: 36%; mechanics: 36%;physics and electricity: 28%.The Council heard a report from itsBudget and Finance Committee and itsWorking Party on Statistics.

Much of the proceedings was devoted tothe adoption of the Organisation´sbudget for 1981 and the Financial Planfor the period 1982 to 1985.

In the light of the opinion of its Budgetand Finance Committee, the Counciladopted a budget for the Organisationtotalling DM 194 446 000 in incomeand expenditure for 1981.The Council adopted a Decisiondetermining the amount of the fee for

Au terme du mandat de Monsieur P.BRAENDLI (Suisse), le Conseil a éluMonsieur R. RAUX (Belgique) à la chargede Vice-Président pour une durée detrois ans.

I Fonctionnement de l´Officeeuropéen des brevets

Monsieur J. B. VAN BENTHEM, Présidentde l´Office, a présenté au Conseil sonrapport sur le développement desactivités de l´Office depuis la dernièresession.Il apparaît que le nombre de demandesdéposées au cours de l´année 1980s´élèverait à environ 19 000 y compris2 000 demandes Euro-PCT. Ces demandesse répartissent dans les domainestechniques suivants:

chimie: 36%: mécanique: 36%;physique et électricité: 28%.Le Conseil a entendu un rapport de saCommission du budget et des financeset de son groupe de travail "Statistiques".

Une grande partie des délibérations aucours de cette session a été consacréeà l´adoption du budget de l´Organisationpour l´année 1981, ainsi que du planfinancier pour les années 1982 à 1985.

Après avis de sa Commission du budgetet des finances, le Conseil a arrêté lebudget de l´Organisation pour 1981, enrecettes et en dépenses, à un montantde 194 446 000 DM.

Ferner wurden mehrere Beschlüsse ge-nehmigt, die die Beamten des Amtsbetreffen.

II Rechtsfragen und InternationaleAngelegenheitenDer Rat hat eine Reihe von Änderungender Ausführungsordnung zum Uberein-kommen genehmigt (siehe S. 3). Diemeisten dieser Änderungen waren imHinblick auf die Anpassung an die ge-änderte Ausführungsordnung zum Ver-trag über die internationale Zusammen-arbeit auf dem Gebiet des Patentwesensvorgeschlagen worden.Entsprechend einer bereits getroffenenGrundsatzentscheidung hat der Rat be-schlossen, die Recherchengebühr fürden ergänzenden Recherchenbericht beiVorliegen eines vom australischen Pa-tentamt erstellten internationalen Recher-chenberichts herabzusetzen (siehe S.5).

III Nächste TagungenDer Rat wird seine 11. Tagung vom 1.bis 5. Juni 1981 und seine 12. Tagungvom 30. November bis 4. Dezember1981 abhalten.

BESCHLIESST:Artikel 1

Die in Artikel 2 Nummer 9 der Ge-bührenordnung vorgesehene Druckkosten-gebühr für eine neue europäische Pa-tentschrift (Artikel 102 Absatz 3 Buchstabeb des Übereinkommens) wird auf 50,-DM festgesetzt.

Artikel 2

Dieser Beschluß tritt am 11. Dezember1980 in Kraft.Geschehen zu München am 11. Dezem-ber 1980.

II Legal and InternationalAffairs

The Council approved a number ofamendments to the ImplementingRegulations to the Convention (see p.3). Most of these amendments wereproposed as a result of amendments tothe Regulations under the Patent Co-operation Treaty.

In accordance with a decision of prin-ciple already taken, the Council decided toreduce the amount of the search fee forthe supplementary search report in thecase of international search reportsdrawn up by the Australian Patent Office(see p. 5).

III Forthcoming meetingsThe Council will hold its 11th meetingfrom 1 to 5 June 1981 and its 12thmeeting from 30 November to 4December 1981.

Le Conseil a adopté une décision fixantle montant de la taxe d´impression d´unnouveau fascicule de brevet européen(voir p. 2).

Plusieurs décisions concernant les fonction-naires de l´Office ont par ailleurs étéadoptées.

Il Affaires juridiques etinternationalesLe Conseil a approuvé un certain nombrede modifications du règlement d´exécu-tion de la Convention (voir p. 3). Laplupart de ces modifications étaientproposées à la suite des amendementsapportés au règlement d´exécution duTraité de coopération en matière debrevets.Conformément à une décision de principedéjà prise, le Conseil a décidé de réduirele montant de la taxe de rechercherelative au rapport complémentaire derecherche dans les cas où un rapport derecherche internationale a été établi parl´Office australien des brevets (voir p. 5).

III Prochaines sessions

Le Conseil tiendra sa 11ème session du1er au 5 juin 1981 et sa 12ème sessiondu 30 novembre au 4 décembre 1981.

Artikel 1

Regel 26 Absatz 2 Buchstabe b derAusführungsordnung erhält folgendeFassung:

"b) die Bezeichung der Erfindung, dieeine kurz und genau gefaßte technischeBezeichnung der Erfindung wiedergibtund keine Phantasiebezeichnung ent-halten darf;"

Artikel 3

Regel 32 Absatz 2 Buchstabe h derAusführungsordnung erhält folgendeFassung:

Sollen Abbil-dungen auf zwei oder mehr Blättern nureine einzige vollständige Abbildung dar-stellen, so sind die Abbildungen auf deneinzelnen Blättern so anzuordnen, daßdie vollständige Abbildung zusam-mengesetzt werden kann, ohne daß einTeil der Abbildungen auf den einzelnenBlättern verdeckt wird. Die einzelnenAbbildungen sind auf einem Blatt oderauf mehreren Blättern ohne Platzver-schwendung anzuordnen, eindeutig von-einander getrennt und vorzugsweise imHochformat; sind die Abbildungen nichtim Hochformat dargestellt, so sind sieim Querformat mit dem Kopf der Abbil-dungen auf der linken Seite des Blattesanzuordnen. Sie sind durch arabischeZahlen fortlaufend und unabhängig vonden Zeichnungsblättern zu numerieren."

Artikel 4

The differentfigures shall be arranged withoutwasting space, preferably in an uprightposition, clearly separated from oneanother. Where the figures are notarranged in an upright position, theyshall be presented sideways with the topof the figures at the left side of the sheet.The different figures shall be numberedconsecutively in arabic numerals, inde-pendently of the numbering of thesheets."

Article 4

The following text shall be substitutedfor Rule 35, paragraph 4, of the Im-plementing Regulations:"(4) The documents making up the Euro-pean patent application shall be on A4paper (29.7 cm x 21 cm) which shall bepliable, strong, white, smooth, matt and

Lorsque desfigures dessinées sur plusieurs feuillessont destinées à constituer une figured´ensemble, elles doivent êtreprésentées de sorte que la figure d´en-semble puisse être composée sans quesoit cachée aucune partie des figures quise trouvent sur les différentes feuilles.Les différentes figures doivent être dis-posées, de préférence verticalement, surune ou plusieurs feuilles, chacune étantclairement séparée des autres mais sansplace perdue: lorsque les figures ne sontpas disposées verticalement, ellesdoivent être présentées horizontale-ment, la partie supérieure des figuresétant orientée du côté gauche de lafeuille; elles doivent être numérotéesconsécutivement en chiffres arabes.indépendamment de la numérotationdes feuilles."

Article 4

Le paragraphe 4 de la règle 35 du règle-ment d´exécution est remplacé par letexte suivant:"(4) Les pièces de la demande de breveteuropéen doivent être remises sur papiersouple, fort, blanc, lisse, mat et durable,de format A4 (29,7 cm x 21 cm). Sous

Artikel 5Regel 35 Absatz 11 der Ausführungs-ordnung erhält folgende Fassung:

"(11) Der Antrag auf Erteilung eineseuropäischen Patents, die Beschreibung,die Patentansprüche und die Zusammen-fassung dürfen keine Zeichnungen ent-halten. Die Beschreibung, die Patent-ansprüche und die Zusammenfassungkönnen chemische oder mathematischeFormeln enthalten. Die Beschreibungund die Zusammenfassung könnenTabellen enthalten. Ein Patentanspruchdarf dies nur dann, wenn sein Gegen-stand die Verwendung von Tabellenwünschenswert erscheinen läßt. Tabellensowie chemische oder mathematischeFormeln können im Querformat wieder-gegeben werden, wenn sie im Hoch-format nicht befriedigend dargestelltwerden können; Blätter, auf denenTabellen oder chemische oder mathe-matische Formeln ??? wiedergegeben wer-den, sind so anzuordnen, daß der Kopfder Tabellen oder Formeln auf der linkenSeite des Blattes erscheint."

Artikel 6

Regel 35 Absatz 12 der Ausführungs-ordnung erhält folgende Fassung:

"(12) Gewichts- und Maßeinheiten sindnach dem metrischen System oder, fallsden Angaben ein anderes System zu-grunde liegt, auch nach dem metrischenSystem anzugeben. Temperaturen sindin Grad Celsius oder, falls den Angabenein anderes System zugrunde liegt, auchin Grad Celsius anzugeben. Für dieübrigen physikalischen Einheiten sinddie in der internationalen Praxis aner-kannten Einheiten, für mathematischeFormeln die allgemein üblichen Schreib-weisen und für chemische Formeln dieallgemein üblichen Symbole, Atomge-wichte und Molekularformeln zu ver-wenden. Grundsätzlich sind nur solchetechnischen Bezeichnungen, Zeichen undSymbole zu verwenden, die auf demFachgebiet allgemein anerkannt sind."

Artikel 7Regel 38 Absatz 3 der Ausführungs-ordnung erhält folgende Fassung:"(3) Die für die Inanspruchnahme derPriorität erforderliche Abschrift derfrüheren Anmeldung ist vor Ablauf dessechzehnten Monats nach dem Prioritäts-tag einzureichen. Die Abschrift mußvon der Behörde, bei der die frühereAnmeldung eingereicht worden ist, alsmit der früheren Anmeldung überein-stimmend bescheinigt sein; der Abschriftist eine Bescheinigung dieser Behördeüber den Tag der Einreichung derfrüheren Anmeldung beizufügen. Ist diefrühere Anmeldung eine europäische

durable. Subject to the provisions of Rule32, paragraph 2 (h), and paragraph 11 ofthis Rule, each sheet shall be used withits short sides at the top and the bottom(upright position)."

Article 5The following text shall be substitutedfor Rule 35, paragraph 11, of the Imple-menting Regulations:

"(11) The request for the grant of a Euro-pean patent, the description, the claimsand the abstract shall not contain draw-ings. The description, the claims and theabstract may contain chemical or mathe-matical formulae. The description andthe abstract may contain tables. Theclaims may contain tables only if theirsubject-matter makes the use of tablesdesirable. Tables and chemical or mathe-matical formulae may be placed side-ways on the sheet if they cannot be pre-sented satisfactorily in an upright posi-tion thereon; sheets on which tables orchemical or mathematical formulae arepresented sideways shall be so pre-sented that the tops of the tables orformulae are at the left side of thesheet."

Article 6

The following text shall be substitutedfor Rule 35, paragraph 12, of the Imple-menting Regulations:

"(12) Units of weights and measuresshall be expressed in terms of the metricsystem. If a different system is used theyshall also be expressed in terms of themetric system. Temperatures shall beexpressed in degrees Celsius. If adifferent system is used they shall alsobe expressed in degrees Celsius. For theother physical values, the units recog-nised in international practice shall beused, for mathematical formulae thesymbols in general use, and for chemicalformulae the symbols, atomic weightsand molecular formulae in general useshall be employed. In general, use shouldbe made of technical terms, signs andsymbols generally accepted in the fieldin question."

Article 7

The following text shall be substitutedfor Rule 38, paragraph 3, of the Im-plementing Regulations:"(3) The copy of the previous applica-tion required for claiming priority shall befiled before the end of the sixteenthmonth after the date of priority. The copymust be certified as an exact copy of theprevious application by the authoritywhich received the previous applicationand shall be accompanied by a certi-ficate issued by that authority stating thedate of filing of the previous application.If the previous application is a Europeanpatent application or an international

La description, lesrevendications et l´abrégé peuvent com-porter des formules chimiques oumathématiques. La description etl´abrégé peuvent comporter destableaux. Les revendications ne peuventcomporter des tableaux que si l´objetdesdites revendications en faitapparaître l´intérêt. Les tableaux et lesformules mathématiques ou chimiquespeuvent être disposés horizontalementsur la feuille s´ils ne peuvent être pré-sentés convenablement verticalement;les feuilles sur lesquelles les tableaux oules formules mathématiques ou chimi-ques sont présentés horizontalement, lesont de telle sorte que les partiessupérieures des tableaux ou desformules soient orientées du côtégauche de la feuille."

Article 6

Le paragraphe 12 de la règle 35 durèglement d´exécution est remplacé parle texte suivant:

"(12) Les unités de poids et de mesuredoivent être exprimées selon le systèmemétrique; si un autre système est utilisé,elles doivent être exprimées égalementselon le système métrique. Les tem-pératures doivent être exprimées endegrés Celsius; si un autre système estutilisé, elles doivent être expriméeségalement en degrés Celsius. Doiventêtre utilisés, pour les autres indicationsphysiques, les unités de la pratique inter-nationale, pour les formules mathémati-ques, les symboles généralement enusage et pour les formules chimiques,les symboles, poids atomiques etformules moléculaires généralement enusage. En règle générale, seuls lestermes, signes et symboles techniquesgénéralement acceptés dans le domaineconsidéré doivent être utilisés."

Article 7

Le paragraphe 3 de la règle 38 du règle-ment d´exécution est remplacé par letexte suivant:

"(3) La copie de la demande antérieurerequise lorsqu´une priorité est revendi-quée est produite avant l´expiration duseizième mois suivant la date de priorité.La copie doit être certifiée conforme parl´administration qui a reçu la demandeantérieure et doit être accompagnéed´une attestation de cette adminis-tration indiquant la date de dépôt de lademande antérieure. Si la demandeantérieure est une demande de breveteuropéen ou une demande interna-

Artikel 8Der Präsident des Europäischen Patent-amts übermittelt den Unterzeichner-staaten des Übereinkommens sowie denStaaten, die diesem beitreten, eine be-glaubigte Abschrift dieses Beschlusses.

Zurücknahme der europäischenPatentanmeldung

Der Anmelder ist an die Zurücknahmeder europäischen Patentanmeldung ge-bunden.

1. An das Europäische Patentamt ist dieFrage gerichtet worden, ob eine zurück-genommene Anmeldung auf Antragdes Anmelders wieder in Behandlunggenommen werden kann.

2. Die Frage ist dahin zu beantworten,daß der Anmelder an eine wirksame,beim Europäischen Patentamt einge-gangene Zurücknahmeerklärung gebun-den ist.

Das EPÜ knüpft verschiedene unmittel-bare Rechtsfolgen an die Zurücknahme-erklärung des Anmelders. Nach Artikel67 Absatz 4 EPU gelten die Schutzwir-kungen der europäischen Patentanmel-dung als von Anfang an nicht eingetreten,wenn die europäische Patentanmeldungzurückgenommen worden ist. Der Tag,an dem die europäische Patentanmel-dung zurückgenommen worden ist, mußnach Regel 92 Absatz 1 Buchstabe nEPÜ in das Patentregister eingetragenund nach Artikel 129 Buchstabe a imPatentblatt veröffentlicht werden. NachRegel 48 Absatz 2 EPÜ entscheidet derZeitpunkt der Zurücknahme darüber, obeine europäische Patentanmeldung ver-öffentlicht wird. Jahresgebühren nachArtikel 86 EPU können nur fällig werden,solange die europäische Patentanmel-dung anhängig ist.

3. Ein geordnetes Erteilungsverfahrenund das öffentliche Interesse an Rechts-sicherheit erfordern es, daß eindeutigfeststeht, in welchem Zeitpunkt die ge-nannten Rechtswirkungen durch die Zu-rücknahmeerklärung verursacht wer-den. Ein Schwebezustand, während dessenunsicher bleibt, ob der Anmelder seineZurücknahmeerklärung nicht etwa wider-ruft, ist hiermit nicht vereinbar. So würdeder Widerruf einer vor Veröffentlichungder Anmeldung erklärten Zurücknahme indie Rechte eines Anmelders eingreifen,gegenüber dessen jüngerer Anmeldungdie ältere Anmeldung nach ihrer Zurück-nahme nicht mehr zum Stand der Tech-nik nach Art. 54 Abs. 3 EPÜ werdenkonnte. Auch die Rechte eines Wettbe-werbers, der den Gegenstand der An-meldung nach deren Zurücknahme in

Withdrawal of a Europeanpatent application

The withdrawal of a European patent ap-plication is binding on an applicant.

1. The European Patent Office has beenasked whether the processing of an ap-plication which has been withdrawn canbe resumed at the request of the ap-plicant.

2. The answer to that question is that avalid notice of withdrawal which hasbeen received at the European PatentOffice is binding on the applicant.The EPC attaches various direct, legalconsequences to a notice of withdrawalby the applicant. Under Article 67, para-graph 4, EPC the European patent ap-plication is deemed never to have hadany protective effect if the Europeanpatent application is withdrawn. Thedate on which the European patentapplication is withdrawn must, undersub-paragraph (n) of Rule 92, paragraph1, EPC, be entered in the Register ofPatents and, under Article 129(a), bepublished in the Patent Bulletin. UnderRule 48, paragraph 2, EPC the date ofwithdrawal determines whether a Euro-pean patent application is published.Renewal fees under Article 86 EPC canonly become due while the Europeanpatent application is pending.

3. For the sake of an orderly grantprocedure and because of the impor-tance, in the public interest, of knowingthe legal position, it is essential for thepoint in time at which the said legaleffects result from a notice of with-drawal to be clearly established. Thisrequirement does not permit of an in-terim state of uncertainty as to whetherthe applicant might perhaps retract hisnotice of withdrawal. For example, theretraction of a notice of withdrawal filedprior to publication of the applicationwould interfere with the rights of anapplicant against whose later applicationthe prior application, once withdrawn,could no longer form part of thestate of the art under Article 54,paragraph 3, EPC. Similarly, the rights ofa competitor who has used the subject-matter of an application after thatapplication´s withdrawal would also beimpaired by retraction, but here the Con-

Retrait de la demande de breveteuropéen

Le demandeur est lié par le retrait de lademande de brevet européen.

1. Il a été demandé à l´Office européendes brevets si l´instruction d´unedemande retirée peut être reprise sur larequête du demandeur.2. La réponse à cette question est que ledemandeur est lié par toute déclarationde retrait valablement effectuée etparvenue à l´Office européen desbrevets.

La Convention sur le brevet européenattache à la déclaration de retrait faitepar le demandeur différentesconséquences juridiques immédiates. Envertu des dispositions de l´article 67,paragraphe 4 de la CBE, les effets de lademande de brevet européen sur le plande la protection sont réputés nuls et nonavenus lorsque la demande de breveteuropéen a été retirée. Conformément àla règle 92, paragraphe 1, lettre n) de laCBE, la date à laquelle la demande debrevet européen a été retirée doit êtreinscrite au Registre européen desbrevets et, conformément à l´article 129,lettre a), publiée dans le Bulletin euro-péen des brevets. Conformément à larègle 48, paragraphe 2 de la CBE, la datedu retrait décide de ce que la pu-blication d´une demande de brevet euro-péen aura lieu ou non. Les taxesannuelles prévues par l´article 86 de laCBE ne sont exigibles qu´aussilongtemps que la demande de breveteuropéen est en cours d´instruction.3. Le bon déroulement de la procédurede délivrance et l´intérêt qu´attache lepublic à la sécurité juridique exigent quesoit fixé clairement le moment auquel ladéclaration de retrait produit les effetsjuridiques qui viennent d´être indiqués.Une période au cours de laquelle règnel´incertitude sur le fait de savoir si ledemandeur ne va pas révoquer sadéclaration de retrait est inconciliableavec un tel objectif.

La révocation d´une déclaration de retraitfaite avant la publication de la demandeporterait par exemple atteinte aux droitsd´un demandeur, par rapport à lademande ultérieure duquel la demandeantérieure, par suite de son retrait, avait

Benutzung genommen hat, werden durcheinen Wideruf beeinträchtigt, ohne daßdas Übereinkommen hierfür einen Aus-gleich schaffen würde, wie dies für denFall des Wiederauflebens einer Anmel-dung durch eine Wiedereinsetzung inden vorigen Stand in Art. 122 Abs. 6EPÜ vorgesehen ist. Das Fehlen einerentsprechenden Regelung für den Widerrufder Zurücknahme steht in Einklang damit,daß das Übereinkommen einen solchenWiderruf nicht vorsieht.4. Die Bindung des Anmelders an dieZurücknahme ergibt sich auch daraus,daß im Übereinkommen an verschiedenenStellen vorgesehen ist, daß eine Anmel-dung als zurückgenommen gilt (z.B. Art.90 Abs. 3, 91 Abs. 5, 94 Abs. 3, 96 Abs.3). Abgesehen von den ausdrücklich vor-gesehenen Fällen der Weiterführung desVerfahrens (Artikel 121 und 122 EPÜ)ist der Eintritt der Zurücknahmefiktionfür den Anmelder bindend, da der einge-tretene Rechtsverlust vom EuropäischenPatentamt lediglich festgestellt wird (Re-gel 69 EPÜ). Die Fiktion der Zurücknahmekann aber nicht umfassendere Wirkungenhaben als die Zurücknahme selbst. Dieszeigt, daß das Übereinkommen von derUnwiderruflichkeit der Zurürcknahme-erklärung ausgeht.

5. Im Fall einer versehentlichen Rück-nahme ist die Anwendung der Regel 88EPÜ in Betracht zu ziehen 1). So kannetwa ein in der Zurücknahmeerklärungdurch einen Schreibfehler unrichtig an-gegebenes Aktenzeichen auf Antrag be-richtigt werden. Auf eine Praxis der zu-ständigen Organe des Europäischen Pa-tentamts kann hinsichtlich der Anwen-dung der Regel 88 EPÜ auf Zurücknahme-erklärungen noch nicht verwiesen werden.

vention makes no provision for com-pensation as it does in Article 122, para-graph 6, EPC regarding the reinstate-ment of an application by re-establish-ment of rights. The absence of a corres-ponding provision concerning retractionof a notice of withdrawal accords withthe view that the Convention does notprovide for such retraction.

4. That the withdrawal is binding on theapplicant also emerges clearly from thefact that various Articles in theConvention provide that an applicationshall be deemed to be withdrawn (e.g.Article 90, paragraph 3, Article 91,paragraph 5, Article 94, paragraph 3,Article 96, paragraph 3). Apart from thecases expressly provided for in which theprocedure is continued (Articles 121 and122 EPC). the fiction of withdrawalis binding on the applicant, since the lossor rights is merely noted by the EuropeanPatent Office (Rule 69 EPC). The fictionof withdrawal cannot, however, havemore far-reaching effects than with-drawal itself. This shows that the Con-vention views the notice of withdrawalas basically irrevocable.

5. In a case of withdrawal by mistake,Rule 88 EPC may be applicable 1). Thus,for example, a wrong file number in thenotice of withdrawal due to an error oftranscription may be corrected on re-quest. It is not as yet possible to draw onactual experience in the competentdepartments of the European PatentOffice in respect of the application ofRule 88 EPC with regard to notices ofwithdrawal.

Le défaut dedisposition correspondante pour larévocation du retrait est en accord avecle fait que la Convention ne prévoit pasune telle révocation.4. Il découle également de ce qu´il estprévu à plusieurs reprises dans la Con-vention qu´une demande est réputéeretirée (par exemple aux articles 90,paragraphe 3, 91, paragraphe 5, 94,paragraphe 3 et 96, paragraphe 3) quele demandeur est lié par le retrait. Ab-straction faite des cas dans lesquels lapoursuite de la procédure est expressé-ment prévue (articles 121 et 122 de laCBE), le jeu de la fiction de retrait lie ledemandeur, étant donné que l´Officeeuropéen des brevets se borne à cons-tater la perte du droit (règle 69 de laCBE). La fiction de retrait ne peutcependant pas avoir de conséquencesplus étendues que le retrait lui-même.Cela montre que la Convention retient leprincipe de l´irrévocabilité de la déclara-tion de retrait.

5. En cas de retrait effectué par erreur, ilconvient d´appliquer la règle 88 de laCBE1). Il est ainsi permis, par exemple,de rectifier sur requête un numéro dedemande inexact, dû à une erreur detranscription dans la déclaration deretrait. Il n´est pas encore possible de seréférer à la pratiques des instancescompétentes de l´Office européen desbrevets en ce qui concerne l´applicationde la règle 88 de la CBE aux déclarationsde retrait.

Mitteilung des Präsidenten desEPA betreffend die Bearbeitungeuropäischer Patentanmel-dungen durch das BritischePatentamt nach Abschnitt IVNummer 1 des Zentralisierungs-protokolls

Das Britische Patentamt hat dem Ver-waltungsrat mitgeteilt, daß es keineeuropäischen Patentanmeldungen mehrzur Bearbeitung nach Abschnitt IVNummer 1 des Zentralisierungsproto-kolls übernehmen möchte, da es derzeitmit der Bearbeitung nationaler Anmel-dungen voll ausgelastet sei.Der Verwaltungsrat hat sich daraufhindamit einverstanden erklärt, daß demBritischen Patentamt zumindest vor-läufig keine europäischen Patentanmel-dungen mehr zur Bearbeitung über-mittelt werden. Diejenigen europäischenAnmeldungen, mit deren Prüfung imBritischen Patentamt bereits begonnenworden ist, werden jedoch dort weiter-bearbeitet, bis sie an die Prüfungs-abteilung in München zurückzuverweisensind.

Das besondere Abkommen zwischendem Britischen Patentamt und der Euro-päischen Patentorganisation nach Ab-schnitt IV Nummer 1 Buchstabe d desProtokolls bleibt in Kraft. Das BritischePatentamt kann also beantragen, daßihm die Bearbeitung europäischer Anmel-dungen wieder übertragen wird, wennkünftig innerhalb des in Abschnitt IVNummer 1 Buchstabe b des Protokollsgenannten Zeitraums von 15 Jahren einBedarf an derartigen Arbeiten entsteht,weil das Personal dieses Amts infolgeder Einführung des europäischen Patent-systems nicht mehr ausgelastet ist. DasEPA hat sich bereit erklärt, solchenAnträgen stattzugeben, falls sein eigenerArbeitsanfall dies zu dem betreffendenZeitpunkt erlaubt.

Neuer Zeitplan für dieVeröffentlichung von Patent-dokumenten des EPASeit Januar 1981 (ab Veröffentlichungs-rate 81/01 vom 07.01.1981) erscheinendie Patentdokumente des EPA nichtmehr, wie bisher, zweiwöchentlich,sondern wöchentlich. Mittwoch alsVeröffentlichungstag wird jedoch beibe-halten.

The British Patent Office has informedthe Administrative Council that, havingregard to its current workload onnational patent applications, it does notwish to be entrusted with any furtherEuropean examination work underSection IV (1) of the Protocol onCentralisation.

The Administrative Council has accord-ingly agreed that no further Europeanapplications should be sent to theBritish Patent Office for examination, atleast for the time being. However,European applications on which exam-ination in the British Patent Office hasalready begun will continue to beprocessed in that Office until such timeas they need to be referred to theExamining Division in Munich.

The special Agreement concluded be-tween the British Patent Office and theEuropean Patent Organisation underSection IV(1)(d) of the Protocol remainsin being. Accordingly, the British PatentOffice may make a request to be againentrusted with European examinationwork if, at some future date withinthe 15 year period referred to in SectionIV(1)(b) of the Protocol, such work isneeded to alleviate staffing difficultiesarising in that Office from the intro-duction of the European patent system.Subject to its own work situation at thedate in question, the EPO has agreed togive favourable consideration to anysuch request.

Toutefois, lesdemandes de brevet européen dontl´Office britannique des brevets a déjàcommencé l´instruction continueront àêtre traitées au sein de cet office,jusqu´au moment où elles devront êtretransmises à la division d´examen àMunich.L´accord spécial conclu entre l´Officebritannique des brevets et l´Organisationeuropéenne des brevets en applicationde la section IV(1) (d) du Protocole de-meure en vigueur. Par conséquent, l´Officebritannique des brevets a la possibilitéde présenter une demande tendant àce que des travaux d´examen en vue dela délivrance de brevets européens luisoient à nouveau confiés si, à unmoment quelconque au cours de lapériode de quinze années visée à lasection IV(1) (b) du Protocole, de telstravaux se révélaient nécessaires pouralléger les difficultés, dues à l´intro-duction du système du brevet européen,que connaîtrait cet office au plan dupersonnel. Attention is drawn to revised Regulations for Examination for the Registration of Patent Agents, made by the Chartered Instituteof Patent Agents, with the consent of the Comptroller-General of Patents, under Rule 8 of the Register of Patent Agents Rules1978 on September 17th, 1980.

The purpose of the revision is the introduction of special rules of examination for European Patent Attorneys who are entered onthe list of professional representatives entitled to act before the European Patent Office by virtue of passing the EuropeanQualifying Examination. Any such European Patent Attorney, if he wishes to qualify for entry in the Register of Patent Agents keptby the Chartered Institute of Patent Agents, must enter for and pass the Chartered Institute Final Qualifying Examination in thetwo Papers on Infringement and Validity of United Kingdom Patents and in the Paper on Patent Agents´ Practice, after havingbeen engaged in the United Kingdom for one year as a full-time pupil or technical assistant to and under the direct personalsupervision of one or more registered patent agents practising in the United Kingdom, and having also passed the CharteredInstitute Intermediate Examination.Copies of the Examination Regulations are available on application to the Registrar, The Chartered Institute of Patent Agents,Staple Inn Buildings, High Holborn, London, WC1V 7PZ.

Artikel 6Währungen

Article 5Payment of fees

(1) Subject to the provisions of Article 6,the fees due to the Office shall be paid inDeutsche Mark or in a currency freelyconvertible into Deutsche Mark:

(a) by payment or transfer to a bankaccount held by the Office,

(b) by payment or transfer to a Giroaccount held by the Office,(c) by money order,

(d) by delivery or remittance of chequeswhich are made payable to the Office or

(e) by cash payment.

(2) The President of the Office may allowother methods of paying fees than thoseset out in paragraph 1, in particular bymeans of fees vouchers or depositaccounts held with the European PatentOffice.

Article 6Currencies

(1) Payments or transfers to a bankaccount or a Giro account in accordancewith Article 5, paragraph 1(a) and (b),shall be made in the currency of theState in which that account is held.(2) Payments in accordance with Article5, paragraph 1(d), shall be made in thenational currency of the country wherethe banking establishment on which thecheque is drawn is located, provided thatthe equivalents of the amounts of feesexpressed in Deutsche Mark have beenlaid down in that currency by the Presi-dent of the Office.

(3) Payments in accordance with Article5, paragraph 1(c) and (e), shall be madein Deutsche Mark or where they aremade to the branch at The Hague or anysub-office set up pursuant to Article 7 ofthe Convention which is empowered toreceive payments, in the currency of theState in which such branch or sub-officeis located.(4) For payments to the Office made incurrencies other than Deutsche Mark,the President of the Office shall, afterconsulting the Budget and Finance Com-mittee if appropriate, lay down theequivalents in such other currencies ofthe fees in Deutsche Mark payablepursuant to these Rules. In doing so,he shall ensure that fluctuations inmonetary rates of exchange are not pre-judicial to the Office. The amounts deter-mined in this way shall be published inthe Official Journal of the EuropeanPatent Office. Revised amounts shall bebinding on all payments for fees whichare due ten days or more after suchpublication; the President of the Officemay, however, shorten this period.

Artikel 7

Angaben über die Zahlung

(1) Jede Zahlung muß den Einzahler be-zeichnen und die notwendigen Angabenenthalten, die es dem Amt ermöglichen,den Zweck der Zahlung ohne weitereszu erkennen.

(2) Ist der Zweck der Zahlung nichtohne weiteres erkennbar, so fordert dasAmt den Einzahler auf, innerhalb einervom Amt zu bestimmenden Frist diesenZweck schriftlich mitzuteilen. Kommt derEinzahler der Aufforderung nicht recht-zeitig nach, so gilt die Zahlung als nichterfolgt.

Artikel 8Maßgebender Zahlungstag

(1) Als Tag des Eingangs einer Zahlungbeim Amt gilt:a) im Fall des Artikels 5 Absatz 1 Buch-staben a und b der Tag, an dem dereingezahlte oder überwiesene Betrag aufeinem Bank- oder Postscheckkonto desAmts gutgeschrieben wird;

b) im Fall des Artikels 5 Absatz 1 Buch-staben c und e der Tag des Eingangs desBetrags der Postanweisung oder der Ein-zahlung des Bargeldbetrags oder derTag, an dem der Betrag der Postan-weisung auf einem Postscheckkonto desAmts gutgeschrieben wird;

c) im Fall des Artikels 5 Absatz 1 Buch-stahe d der Tag, an dem der Scheckbeim Amt eingeht, sofern dieser Scheckeingelöst wird.(2) Läßt der Präsident des Amts gemäßArtikel 5 Absatz 2 zu, daß die Gebührenauf andere Art als in Artikel 5 Absatz 1vorgesehen entrichtet werden, so be-stimmt er auch den Tag, an dem dieseZahlung als eingegangen gilt.(3) Gilt eine Gebührenzahlung gemäßden Absätzen 1 und 2 erst nach Ablaufder Frist als eingegangen, innerhalb dersie hätte erfolgen müssen, so gilt dieseFrist als eingehalten, wenn dem Amtnachgewiesen wird, daß der Einzahlerspätestens zehn Tage vor Ablauf dergenannten Frist in einem Vertragsstaat:a) die Zahlung des Betrags bei einemBankinstitut oder Postamt veranlaßt hatoder

b) einen Auftrag zur Überweisung des zuentrichtenden Betrags einem Bankin-stitut oder Postscheckamt formgerechterteilt hat oder

c) dem Postamt einen an das Amtgerichteten Brief übergeben hat, in demein dem Artikel 5 Absatz 1 Buchstabe dentsprechender Scheck enthalten ist,sofern dieser Scheck eingelöst wird.

Das Amt kann den Einzahler auffordern,innerhalb einer vom Amt zu bestimmen-den Frist diesen Nachweis zu erbringen.Kommt der Einzahler dieser Aufforde-rung nicht nach oder ist der Nachweisungenügend, so gilt die Zahlungsfrist alsversäumt.

Article 7Particulars concerning payments

(1) Every payment must indicate thename of the person making the paymentand must contain the necessary parti-culars to enable the Office to establishimmediately the purpose of the payment.!2) If the purpose of the payment cannotimmediately be established, the Officeshall require the person making thepayment to notify it in writing of thispurpose within such period as it mayspecify. If he does not comply with thisrequest in due time the payment shall beconsidered not to have been made.

Article 8Date to be considered as the date

on which payment is made

(1) The date on which any payment shallbe considered to have been made to theOffice shall be as follows:(a) in the cases referred to in Article 5,paragraph 1(a) and (b): the date onwhich the amount of the payment or ofthe transfer is entered in a bank accountor a Giro account held by the Office;(b) in the cases referred to in Article 5,paragraph 1 (c) and (e): the date ofreceipt of the amount of the moneyorder or of the cash payment or the dateon which the amount of the money orderis entered in a giro account held by theOffice;(c) in the case referred to in Article 5,paragraph 1 (d): the date of receipt of thecheque at the Office, provided that thecheque is met.

(2) Where the President of the Officeallows, in accordance with the pro-visions of Article 5, paragraph 2, othermethods of paying fees than those setout in Article 5, paragraph 1, he shallalso lay down the date on which suchpayments shall be considered to havebeen made.(3) Where, under the provisions of para-graphs 1 and 2, payment of a fee is notconsidered to have been made until afterthe expiry of the period in which itshould have been made, it shall be con-sidered that this period has beenobserved if evidence is provided to theOffice that the person who made thepayment fulfilled one of the followingconditions in a Contracting State not laterthan ten days before the expiry of suchperiod:(a) he effected the payment through abanking establishment or a post office;

(b) he duly gave an order to a bankingestablishment or a post office to transferthe amount of the payment;(c) he dispatched at a post office a letterbearing the address of the Office andcontaining a cheque within the meaningof Article 5, paragraph 1 (d), providedthat the cheque is met.The Office may request the person whomade the payment to produce suchevidence within such period as it mayspecify. If he fails to comply with thisrequest or if the evidence is insuf-ficient, the period for payment shall beconsidered not to have been observed.

Article 7Données concernant le paiement

(1) La date à laquelle tout paiement estréputé effectué auprès de l´Office estfixée comme suit:a) dans les cas visés à l´article 5, para-graphe 1, lettres a) et b): date à laquelle lemontant du versement ou du virementest porté au crédit d´un compte bancaireou d´un compte de chèques postaux del´Office;b) dans les cas visés à l´article 5, para-graphe 1, lettres c) et e): date de l´en-caissement du montant du mandatpostal ou des espèces, ou date à laquellele montant du mandat postal est portéau crédit d´un compte de chèquespostaux de l´Office;c) dans le cas visé à l´article 5, para-graphe 1, lettre d): date de réception duchèque par l´Office sous réserve de l´en-caissement de ce chèque.

(2) Lorsque le Président de l´Office auto-rise, conformément aux dispositions del´article 5, paragraphe 2, le paiement destaxes par d´autres moyens que ceux pré-vus au paragraphe 1 dudit article, il fixeégalement la date à laquelle ce paiementest réputé effectué.

(3) Lorsque, en vertu des dispositionsdes paragraphes 1 et 2, le paiementd´une taxe n´est réputé effectué qu´aprèsl´expiration du délai dans lequel il auraitdû intervenir, ce délai est considérécomme respecté si la preuve estapportée à l´Office que la personne qui aeffectué le paiement dans un Etat con-tractant a rempli au plus tard dix joursavant l´expiration dudit délai l´une desconditions ci-après:a) avoir effectué le paiement auprès d´unétablissement bancaire ou d´un bureaude poste;b) avoir donné un ordre Je virement, enbonne et due forme, du montant du paie-ment à un établissement bancaire ou àun bureau de chèques postaux;c) avoir déposé dans un bureau de posteune lettre portant l´adresse du siège del´Office et contenant un chèque visé àl´article 5, paragraphe 1, lettre d), sousréserve de l´encaissement de ce chèque.L´Office peut inviter la personne qui aeffectué le paiement à en apporter lapreuve, dans le délai qu´il détermine. S´iln´est pas donné suite à cette invitationou si la preuve apportée n´est passuffisante, le délai de paiement est con-sidéré comme n´ayant pas été respecté.
